A. Le contrôle des assurés au temps des informations limitées
Le contrôle des assurés par les fichiers se déploie sur deux échelles
distinctes, celle de la mutualité, c'est-à-dire de l'ensemble des assurés (1),
et celle de l'individu (2).

1. Le contrôle de la mutualité
Les assureurs ont par essence besoin de maîtriser les risques qu'ils
couvrent. Grâce à la loi des grands nombres et aux statistiques, ils sont à
même de réaliser l'opération d'assurance et de neutraliser le hasard19. en
d'autres termes, si chaque relation assurantielle est marquée par l'aléa, par
l'incertitude, à l'échelle de la mutualité, par principe et par construction, il
n'y a pas de place pour le hasard. C'est ici que la collecte de données joue
un rôle essentiel : appréhender le risque, c'est être capable de l'évaluer, de
le mesurer, d'élaborer des statistiques. D'une certaine manière, on assure
bien que ce que l'on connaît bien.
Les assureurs ont d'ailleurs intérêt à faire en sorte d'améliorer la configuration des risques. Ils jouent de ce point de vue un rôle normatif, incitant
notamment à la prévention, en amont des sinistres, et à la protection, en aval
de ceux-ci, quand il s'agit d'en limiter autant que possible les conséquences
par des mesures de sauvetage ou d'assistance par exemple.
L'exploitation des données recueillies et des fichiers constitués conduit
ainsi à délimiter les obligations de couverture et de règlement de l'assureur.
De la sorte, une normalisation des comportements des assurés se met en
place, qui repose sur les données d'expérience, collectées et analysées.

2. Le contrôle des individus
Quant au contrôle individuel des assurés, il intervient d'abord, et naturellement, lors de la phase précontractuelle. examiner la proposition
d'assurance, c'est évaluer le risque apporté à l'aune des données transmises
par le futur assuré lorsqu'il déclare les risques, en répondant aux questions
qui lui sont posées par l'assureur20. Ne pas contracter ou contracter à
telles ou telles conditions, c'est classer les candidats à l'assurance, opérer
un contrôle.
