raison de ses fonctions l'obligation de secret professionnel prévue par l'article 226-13 du Code pénal. enfin, les traitements nécessaires à la recherche
dans le domaine de la santé ou justifiés par l'intérêt général peuvent être
autorisés par la CNIL.
Incontestablement, les données de santé sont l'objet non seulement de
préoccupations de santé publique, de recherche, de démocratie sanitaire,
mais encore d'enjeux économiques. La financiarisation des données de
santé existe d'ores et déjà dans certains pays, à l'instar des États-Unis, où
un dossier patient peut se revendre 600 dollars48. À l'évidence, les évolutions technologiques invitent à repenser le statut des données de santé et
les modalités de leur protection.
en ce qui concerne le sexe des assurés, la situation a évolué de manière
radicale ces dernières années puisque, depuis le 21 décembre 2012, toute
différence de traitement liée au sexe de l'assuré est prohibée49. en conséquence, quand bien même les assureurs disposent de l'information sur le
sexe de l'assuré, ils ne peuvent l'utiliser, alors même que, pour prendre
l'exemple simple des assurances décès, on sait bien que l'espérance de vie
masculine est plus faible que celle féminine.
Il existe donc des règles qui interdisent l'utilisation de certaines données
voire prohibent leur collecte. Pour autant, en dehors de ces règles, la liberté
de ficher n'est pas absolue. Constituer un fichier implique de respecter le
droit des données personnelles, bien que celui-ci comporte des faiblesses.

B. Les faiblesses : les fichiers autorisés
Le droit des données personnelles comporte quelques faiblesses au sens
où le dispositif Informatique et Libertés ne paraît pas nécessairement offrir
le niveau de garantie attendu, pour des raisons à la fois structurelles (1) et
conjoncturelles (2), c'est-à-dire en raison de la loi elle-même et de la politique menée par la CNIL, second régulateur public de l'activité d'assurance,
après l'Autorité de contrôle prudentiel et de résolution50.
