cherchera une solution amiable tout en respectant l'autonomie d'Interpol,
en revanche une pression politique sur la CCF, attentive à défendre son
indépendance, aura généralement un effet contre-productif... Toutes les
organisations internationales connaissent les désagréments des interférences
politiques ; il est normal qu'Interpol n'y échappe pas, l'essentiel étant dans
la capacité suffisante d'y résister...
Les conséquences fortement négatives pour les personnes fichées du nonrespect des règles statutaires et des processus de gestion des informations
des fichiers soulèvent d'autres difficultés entre les États et Interpol, avec une
grande actualité, qui devrait déboucher sur des évolutions importantes du
rTD. on citera en particulier la question de savoir qui, de l'État membre
BCN ou de l'organisation, et à quelle étape de gestion des informations des
fichiers, endossera la responsabilité totale ou partagée en cas de contentieux
ou d'arbitrages internationaux provoqués par une personne fichée victime
dans ses droits lors d'un dysfonctionnement. Ceci débouche sur la question
des formes de réparation - y compris financière -, de la contestation du
privilège de juridiction d'Interpol, de sa responsabilité internationale, etc.

B. Les protections des droits et libertés des personnes fichées
Aussi étonnant que cela puisse paraître, la personne fichée à Interpol,
même quand elle est un dangereux criminel, dispose de droits à faire valoir
auprès de l'organisation qui doit les respecter pour observer son propre
statut.
en effet, l'article 2-a, du statut modifié de 1956, prévoit expressément que
Interpol doit respecter dans ses actions « les lois existantes dans les différents pays et l'esprit de la Déclaration universelle des droits de l'homme » ;
ce principe s'applique directement et obligatoirement aux informations,
aux fichiers de l'organisation.
Interpol doit respecter l'ensemble des droits et libertés fondamentaux
consacrés internationalement des personnes figurant dans ses fichiers (y
compris ceux relatifs à la gestion de son personnel), dont les standards
mondiaux en matière de protection des données personnelles et de respect
des principes du due process of law.
Si l'obligation statutaire s'applique à l'ensemble des structures d'Interpol,
l'organisation dispose cependant d'une structure originale et particulière pour contrôler le respect notamment des articles 2 et 3 du statut, la
Commission de contrôle des fichiers d'Interpol (CCF), en liaison avec
l'application des textes internes et du rTD. La CCF est une structure indépendante, hors hiérarchie, mise en place en 1984 dans le cadre de l'accord
de siège signé avec la France. La CCF a vu son statut renforcé en 2008
