La procédure pénale doit respecter le droit à la présomption d'innocence, affirmé par la Déclaration de 1789. Une personne ne peut
être déclarée coupable tant que sa culpabilité n'est pas légalement
établie. Les droits de la défense sont détaillés, sur le modèle du
sixième amendement apporté à la Constitution des États-Unis en
1791. En France, un article préliminaire a été ajouté au Code de procédure pénale par la loi du 15 juin 2000 pour y inscrire le droit à la
présomption d'innocence et les droits de la défense.
L'accusé a droit à être informé de la nature et de la cause de
l'accusation portée contre lui. Les faits sont la « cause », leur qualification juridique en définit la « nature ». Ceci, « dans le plus court
délai » et « dans une langue qu'il comprend ». C'est la condition qui
lui permet de préparer sa défense, à l'opposé de l'accusé dans le
livre Le Procès, de Franz Kafka, publié en 1925, qui est arrêté sans
savoir, jusqu'à son exécution, de quoi il est accusé.
L'accusé doit pouvoir préparer sa défense. Il a le droit de se
défendre lui-même ou par l'intermédiaire d'un avocat. Ce droit à
l'assistance d'un avocat s'exerce tout au long de la procédure, y
compris lors de l'interrogatoire par la police. Il a le droit d'interroger
les témoins, à charge comme à décharge. Il a le droit de se faire
assister gratuitement d'un interprète.
Le Protocole nº 7 ajouté à la Convention européenne des droits
de l'homme en 1984, garantit un nouveau droit : le droit à un double
degré de juridiction en matière pénale. On a pu lui trouver comme
antécédent la provocatio en droit romain, qui donnait à la personne
condamnée à la peine capitale par un magistrat, le droit de faire
appel devant les Comices, assemblées du peuple. Ce droit a été
inscrit dans le Code de procédure pénale en France par la loi du
15 juin 2000 qui a institué un appel des décisions des cours d'assises.
