preuves, il peut prendre des décisions qui sont des mandats : mandat de recherche, mandat de comparution, mandat d'amener, mandat d'arrêt. En tant que juridiction, il rend des ordonnances. À la fin
de l'instruction, il prend une ordonnance de non-lieu, s'il considère
que les charges ne sont pas suffisantes, ou une ordonnance de renvoi de la personne poursuivie devant la juridiction de jugement.
La fonction du juge d'instruction met en jeu de façon sérieuse la
liberté individuelle, spécialement lorsqu'il décide de la mise en
détention provisoire d'une personne mise en examen. C'est la raison
pour laquelle la loi du 15 juin 2000 a confié cette mission à un autre
juge, le juge des libertés et de la détention.
Auparavant des lois (1985, 1987, 1993) avaient tenté de confier la
décision de mise en détention provisoire à des formations collégiales
de plusieurs juges. Ces lois ne furent pas appliquées, faute de
moyens budgétaires. Après que l'affaire d'Outreau ait montré comment un juge d'instruction pouvait être débordé par sa mission12, la
loi du 5 mars 2007 a voulu instaurer la collégialité de l'instruction en
général. Après que son application ait été reportée plusieurs fois,
cette réforme a été abrogée par une loi du 18 novembre 2016. En
revanche, une forme de collégialité instaurée par la loi du 5 mars
2007 a été mise en œuvre : des pôles de l'instruction, réunissant plusieurs juges d'instruction, ont été créés dans certains tribunaux.
Juridictions de l'application des peines. - Traditionnellement, l'exécution des peines relevait du pouvoir exécutif. En 1911, l'administration pénitentiaire, jusque-là dépendante du ministre de l'Intérieur,
fut rattachée au ministère de la Justice. Un juge de l'application
des peines fut créé en 1958. Sa mission était d'adapter l'exécution
des peines privatives de liberté ou de certaines peines restrictives
de liberté. Mais la procédure suivie devant lui avait un caractère
administratif. La loi du 15 juin 2000 a « judiciarisé » la procédure,
notamment en instaurant le principe d'un débat contradictoire précédant la décision du juge13. En 2004, fut créé un tribunal de l'application des peines.
Dans le ressort de chaque tribunal de grande instance, il y a un
ou plusieurs juges de l'application des peines. Chaque juge statue
comme juge unique. Dans le ressort de chaque cour d'appel, il existe
un ou plusieurs tribunaux de l'application des peines composés d'un
