mineurs, plus qu'à la protection des mineurs. Ces réponses purent
être éphémères, comme la création de tribunaux correctionnels des
mineurs en 2011, supprimés en 2016.
L'ordonnance du 2 février 1945 a connu de nombreuses réformes, une quarantaine. La loi du 23 mars 2019 habilite le gouvernement à réformer cette ordonnance par ordonnances, pour créer un
Code de la justice pénale des mineurs.
Les juridictions spéciales pour les mineurs correspondent aux dispositions de la convention internationale des droits de l'enfant de
1989 qui appellent les États à « la mise en place d'autorités et d'institutions spécialement conçues pour les enfants suspectés, accusés ou
convaincus d'infraction à la loi pénale ». Les juridictions pour mineurs
« prononcent des mesures de protection, d'assistance, de surveillance et d'éducation ». Elles ne peuvent prononcer une sanction éducative, à partir de dix ans, ou une peine, à partir de treize ans, que
« lorsque les circonstances et la personnalité des mineurs l'exigent ».
Le juge des enfants est un juge unique qui appartient au tribunal
de grande instance. Il est compétent pour juger les contraventions,
les délits commis par un mineur de moins de 18 ans, les crimes par
un mineur de moins de 16 ans. Mais son rôle est essentiellement
éducatif. Il peut prescrire des mesures d'assistance éducative mais
ne peut prononcer de peines. S'il l'estime nécessaire, il transmet
l'affaire au tribunal pour enfants.
Le tribunal pour enfants est une juridiction collégiale. Il y en a au
moins un par département. Il est présidé par un juge des enfants
entouré de deux assesseurs qui ne sont pas des magistrats, mais
des personnes « qui se sont signalées par l'intérêt qu'elles portent
aux questions de l'enfance et par leurs compétences » (COJ, art.
L. 251-4). Ils sont nommés par le ministre de la Justice.
Depuis une décision du Conseil constitutionnel de 2011, le juge des
enfants qui a instruit l'affaire ne peut plus présider le tribunal devant
laquelle il l'a renvoyée, pour satisfaire à l'exigence d'impartialité.
La compétence du tribunal est la même que celle du juge des
enfants, mais il peut prononcer une sanction éducative ou une peine.
La cour d'assises des mineurs a été créée par une loi du 24 mai
1951. Sa composition est celle d'une cour d'assises de droit commun. Sa particularité est que les deux assesseurs du président
sont généralement choisis parmi des juges des enfants.
Elle est compétente pour juger les crimes commis par des
mineurs entre 16 et 18 ans.
