garde ainsi la maîtrise de l'élaboration de la jurisprudence administrative qui ne peut varier selon les territoires.
En première instance, le Conseil d'État a une compétence en
premier et dernier ressort pour quatre blocs principaux de recours :
les recours contre les actes administratifs nationaux les plus importants (ordonnances, décrets, actes réglementaires des ministres),
les litiges concernant les agents publics nommés par décret du président de la République, les recours contre les décisions prises par
certaines autorités administratives indépendantes, les contestations
de certaines élections (députés au Parlement européen, conseils
régionaux)21.
Le Conseil d'État garde une compétence en appel réduite. Elle
concerne les élections municipales et cantonales, les recours en
appréciation de la légalité émanant du juge judiciaire et les recours
de référé-liberté. Le Conseil d'État est également compétent en
appel des jugements rendus en premier ressort par « les autres juridictions administratives » que les tribunaux administratifs, sauf si la
loi a institué une instance d'appel particulière. Il s'agit des juridictions administratives à compétence spéciale.
Le Conseil d'État a pour fonction principale, depuis 1987, d'être
juge de cassation. Il est « seul compétent pour statuer sur les
recours en cassation dirigés contre les décisions rendues en dernier
ressort par toutes les juridictions administratives » (CJA, art. L. 331-1).
Mais pour qu'il ne soit pas à nouveau débordé, une procédure préalable d'admission a été mise en place, qui lui permet d'écarter les
recours qui ne sont fondés « sur aucun moyen sérieux ». Il ne retient
que le tiers des recours en cassation.
En tant que juge de cassation, il ne connaît que des moyens de
droit, les moyens de cassation. Il ne contrôle que la légalité de la
décision qui lui est soumise, qu'il peut « casser », c'est-à-dire annuler. Quant aux effets de cette cassation, ils peuvent se distinguer de
ceux d'une cassation judiciaire. Le Conseil d'État peut renvoyer l'affaire devant la même juridiction ou devant une autre juridiction de
même nature. Mais il peut aussi décider de régler lui-même l'affaire
au fond « si l'intérêt d'une bonne administration de la justice le justifie » (CJA, art. L. 821-2). C'est ce qu'il décide le plus souvent. Cela
lui permet de conforter sa fonction de Cour suprême régulatrice en
assurant l'unité de la jurisprudence.
