sont chargés de prescrire l'exécution des recettes et des dépenses.
Les comptables publics sont chargés de prendre en charge et
recouvrer les recettes des organismes publics et de payer les
dépenses. La séparation des deux fonctions est une garantie de probité et permet le contrôle de la régularité des actes. Les comptables
publics sont personnellement et pécuniairement responsables de
leurs comptes. Comptables publics et ordonnateurs relèvent de juridictions différentes, la Cour des comptes et les chambres régionales
et territoriales des comptes pour les premiers, la Cour de discipline
budgétaire et financière pour les seconds. Elles sont régies par le
Code des juridictions financières promulgué en 1994.
La Cour des comptes. - À la veille de la Révolution, il existait quatorze chambres des comptes, cours souveraines issues pour la plupart du régime féodal24. La Déclaration des droits de l'homme et du
citoyen de 1789 affirme que « la société a le droit de demander
compte à tout agent public de son administration ». La Cour des
comptes a été instituée en 1807. Elle contrôle les comptes des
comptables publics. Elle rend des arrêts de « décharge » ou de
« quitus » si la gestion a été régulière ou, à l'inverse, des arrêts de
« débet ». Dans ce cas, le comptable public est en principe tenu de
payer la différence sur ses propres deniers. Une loi de 1963 permet
toutefois aux comptables publics d'obtenir du ministre du Budget la
remise gracieuse des sommes mises à leur charge.
La Cour des comptes a aussi des missions non juridictionnelles.
Elle assiste le Parlement et le gouvernement dans le contrôle de
l'exécution des lois de finances. Elle rend un rapport annuel sur l'efficacité de la gestion financière des administrations, des collectivités
et des entreprises publiques.
Les chambres régionales et territoriales des comptes. - Elles sont
nées de la décentralisation réalisée en 1982. Leur mission est de
contrôler les comptes des comptables publics des collectivités territoriales et de leurs établissements publics. En outre, elles exercent
un contrôle de gestion, pour vérifier que les crédits n'ont pas été
détournés de leur affectation publique. Enfin, elles exercent un
contrôle budgétaire sur les collectivités locales. Leurs jugements
sont soumis en appel à la Cour des comptes.
En 1982, il avait été créé une chambre dans chaque région. Leur
nombre a été réduit : depuis 2016, il existe 13 chambres régionales
