Introduction au droit
regroupant les membres d'une profession libérale comme les
médecins, les architectes, les experts-comptables. Le contentieux
peut relever d'une chambre régionale en première instance, d'une
chambre nationale en appel.
Certains agents publics sont justiciables d'une juridiction spécialisée. C'est le cas des magistrats judiciaires du siège, justiciables du
Conseil supérieur de la magistrature, ou des magistrats administratifs, justiciables du Conseil supérieur des tribunaux administratifs et
des cours administratives d'appel. C'est aussi le cas des enseignants-chercheurs des universités, justiciables, en première instance de la section disciplinaire du conseil d'administration de leur
université, en appel de la section disciplinaire du Conseil national de
l'enseignement supérieur et de la recherche.
La composition de ces diverses juridictions fait appel à des
magistrats non professionnels.
C. Le Conseil constitutionnel
Le Conseil constitutionnel est-il une juridiction ? Il a plusieurs
missions. Certaines ne sont certainement pas juridictionnelles : le
Conseil constitutionnel est chargé de veiller au respect de l'article 34 de la Constitution, qui limite le domaine de la loi, comme à
la régularité de la mise en œuvre de l'article 16 qui permet au président de la République d'avoir des pouvoirs exceptionnels en temps
de crise institutionnelle. Il a aussi des missions juridictionnelles : il
examine les contestations relatives à des élections nationales (président de la République, députés, sénateurs). Il statue dans ce cas
en tant que juridiction. La Cour européenne des droits de l'homme
a considéré dans une affaire de contentieux électoral que le Conseil
constitutionnel était une juridiction.
Mais le Conseil constitutionnel peut aussi être appelé à contrôler
la constitutionnalité des lois. C'est dans ce cas que la question de
son caractère juridictionnel a été posée aux débuts de la Ve République, notamment au regard de sa composition et de la procédure
suivie devant lui.
Il n'est pas composé de juges professionnels mais de personnalités choisies librement par trois autorités politiques : le président de
la République, le président de l'Assemblée nationale et le président
du Sénat. De plus, les anciens présidents de la République en sont
membres de droit, à vie. Un projet de loi constitutionnelle du 9 mai
2018 tend à supprimer pour l'avenir ce droit. De fait, une majorité
