Introduction au droit
Ces juridictions sont créées par un traité : la Cour internationale
de justice est instituée par la Charte des Nations unies. Le Tribunal
international du droit de la mer est créé par une Convention des
Nations unies. L'Organe de règlement des différends de l'Organisation mondiale du commerce (OMC) est créé par les accords de
l'OMC. La Cour pénale internationale (CPI) est créée par une
convention adoptée dans le cadre des Nations unies, le Statut de
Rome.
Elles ont pu être précédées de juridictions ad hoc créées de façon
unilatérale lorsqu'il s'agissait de punir des criminels de guerre dans
des circonstances particulières : le Tribunal international de Nuremberg et le Tribunal militaire international de Tokyo ont été créés par
les alliés au lendemain de la Seconde Guerre mondiale. Dans les
années 1990, des résolutions du Conseil de sécurité des Nations
unies créèrent le Tribunal pénal international pour l'ex-Yougoslavie,
puis le Tribunal pénal pour le Rwanda.
Les États ne sont liés par la convention créant une juridiction que
s'ils l'ont signée ou ratifiée ou s'ils y ont adhéré. La seule exception
au consentement étatique préalable concerne la Cour pénale internationale. Elle pourrait juger les ressortissants d'un État non partie
à son Statut pour des faits commis sur le territoire d'un autre État, à
condition que ce dernier en soit partie. Elle pourrait aussi être saisie
par le Conseil de sécurité des Nations unies, mais parmi ses 5
membres permanents, la Chine n'a pas signé le Statut instituant la
Cour pénale internationale, et les États-Unis et la Russie ne l'ont
pas ratifié.
Les États ayant accepté la création d'une juridiction n'en sont pas
obligatoirement justiciables. Dans certains cas, leur consentement
exprès est nécessaire pour être jugé par la nouvelle juridiction. La
compétence de la Cour internationale de justice est soumise à une
déclaration facultative d'acceptation de juridiction obligatoire. Tous
les membres des Nations unies ne l'ont pas signée. Et ils peuvent
retirer leur acceptation. En revanche, tous les États qui adhèrent à
l'OMC sont liés par les règles relatives à l'Organe de règlement des
différends.
C'est généralement le traité fondateur qui constitue la base juridique des décisions juridictionnelles. Chaque juridiction internationale a pour mission d'appliquer et d'interpréter le traité qui l'a instituée. Elle veille à son respect. La Cour internationale de justice a
une fonction plus large, sa compétence est générale : elle concerne
