Les sources du droit
A. Une source du droit ?
Plusieurs cas peuvent être distingués. La doctrine n'a jamais dit
le droit, mais elle a pu prendre une certaine place laissée vacante
par les autres sources. Elle a pu être invitée ou habilitée à donner
des avis ayant une portée juridique. Dans d'autres systèmes juridiques, elle peut n'avoir aucune place. S'opposent les pays de droit
romaniste et ceux de common law.
Une invitation. - Dans la République romaine, les « jurisconsultes » succèdent aux pontifes, corps de prêtres qui détenait seul la
connaissance du droit d'origine sacrée. Les jurisconsultes sont des
juristes formés par la pratique qui deviennent des consultants : ils
donnent des conseils juridiques aux plaideurs, puis aux préteurs et
aux juges, qui n'ont pas de formation juridique. L'âge d'or des jurisconsultes dure trois siècles, jusqu'à ce que les préteurs puissent
eux-mêmes créer de nouvelles règles, grâce à la loi Aebutia, vers
150 av. J.-C.
Une habilitation. - À Rome, l'Empereur charge des jurisconsultes
de répondre à des questions de droit. Ces réponses s'imposent aux
juges. En 426 après J.-C., la loi des citations donne valeur obligatoire
aux opinions concordantes de certains anciens jurisconsultes.
En 530 après J.-C., l'Empereur romain d'Orient, Justinien, décide
d'ajouter au code, qui est un recueil de compilations impériales, le
Digeste, recueil de citations de jurisconsultes romains.
Le statut de la Cour internationale de justice de 1945 donne la liste
des sources auxquelles elle peut se référer, qu'elle « applique ». Ce
sont les conventions internationales, la coutume internationale, les
principes généraux du droit reconnus par les nations civilisées, les
décisions judiciaires et « la doctrine des publicistes les plus qualifiés
des différentes nations », comme « moyens auxiliaires de détermination des règles de droit ». Cela correspond à une certaine incomplétude du droit international, en cours d'élaboration.
Une absence. - En Angleterre, pays de common law, ce sont les
juges qui créent le droit. « Avec leur habitude de rédiger des décisions abondantes et très fortement argumentées, (ils) coupent
l'herbe sous les pieds des docteurs »15.
À la fin du XIXe siècle, les universitaires allemands et français
tentent de redonner son lustre à la doctrine, en l'érigeant en
