Introduction au droit
infligées aux coupables, au terme d'une enquête établissant leur
responsabilité. La procédure pénale définit les conditions de cette
mise en œuvre.
* Le droit pénal : des choix de société
Le principe de légalité signifie que la loi définit les infractions,
c'est-à-dire les actes répréhensibles et les peines qui leur sont
applicables. Ce principe est ancien, formulé ainsi dans l'Antiquité :
nullum crimen, nulla poena sine lege. En France, sous l'Ancien
Régime, c'était la coutume qui définissait les infractions et les peines. La Déclaration des droits de l'homme de 1789 posa un principe :
« Nul ne peut être puni qu'en vertu d'une loi établie et promulguée
antérieurement au délit et légalement appliquée » (art. 8).
Première assemblée révolutionnaire, la Constituante classa les
infractions en trois catégories : les crimes, les délits et les contraventions. Le premier article du Code pénal de 1992 énonce : « Les
infractions pénales sont classées, suivant leur gravité, en crimes,
délit et contraventions » (art. 111-1). Ce « critère de gravité ne peut
se fonder que sur une hiérarchie des valeurs de la société »3. Cette
classification correspond à une spécialisation des juridictions : les
crimes sont jugés par les cours d'assises, les délits par les tribunaux correctionnels, les contraventions par les tribunaux de police.
L'évolution de la société fait que certains actes peuvent être considérés comme des crimes ou des délits ou ne pas être punissables.
Ainsi l'avortement fut puni comme un crime jusqu'à une loi de 1920
qui en fit un délit, puis, à nouveau, comme un crime sous le régime
de Vichy. La loi du 17 janvier 1975 permet sous certaines conditions
une « interruption volontaire de grossesse » qui n'est pas une infraction. La grève était une contravention selon la loi Le Chapelier de
1791, un délit en application du Code pénal de 1810. Ce délit (« de
coalition ») fut supprimé par une loi de 1864.
La nature des peines a considérablement évolué dans le sens de
leur adoucissement. Dans le Code d'Hammourabi, comme dans
l'Ancien Testament, la loi du talion imposait la peine de mort ou la
mutilation du coupable. La peine de mort et les supplices étaient
prévus par le droit de l'Ancien Régime. La publication, en 1764, du
Traité des délits et des peines écrit par Cesare Beccaria, influença
les juristes dans toute l'Europe. Il dénonçait la rigueur des peines.
