Introduction au droit
Dans la pratique, les procédures empruntent des éléments à ces
deux types. La part du pouvoir et celle des droits des individus ont
évolué dans le temps.
La part du pouvoir. - L'indépendance des juges à l'égard du pouvoir politique est la condition pour que la justice pénale ne soit pas
un moyen pour le pouvoir de punir ses ennemis. En France, le principe de cette indépendance n'est acquis que depuis la Constitution
de 1946. Mais c'est le ministère public qui a la charge de mettre en
mouvement l'action publique, de diriger l'exercice de la police judiciaire et de « requérir l'application de la loi ». Les magistrats du
ministère public reçoivent des instructions du garde des Sceaux,
ministre de la Justice et sont placés sous son autorité. Depuis les
années quatre-vingt, la question de leur indépendance a été posée,
spécialement par la Cour européenne des droits de l'homme. Le
Conseil constitutionnel a considéré que les magistrats du parquet
étaient indépendants, mais qu'il fallait concilier cette indépendance
avec les prérogatives du gouvernement4.
Les droits des justiciables. - Les individus déférés devant la justice pénale bénéficient, selon la Déclaration de 1789, de la présomption d'innocence. Les droits de la défense en sont le corollaire. La
torture, pratiquée sous l'Ancien Régime pour obtenir des aveux, est
bannie. Le droit à un avocat dès la première comparution devant un
juge, affirmé en 1789, supprimé ensuite, fut acquis en 1897. La
Convention européenne des droits de l'homme de 1950 développa
la notion de droits de la défense, telle qu'elle existait dans le droit
anglo-saxon. Une loi du 15 juin 2000 reprit ces avancées dans un
article préliminaire du Code de procédure pénale. La possibilité
d'un appel devant une autre juridiction est généralisée.
Mais un droit d'exception se développe depuis la fin du XXe siècle,
lorsque la procédure concerne des infractions liées au terrorisme.
2. Le droit fiscal
Les empires anciens ont trouvé dans l'impôt un moyen de se procurer les ressources nécessaires pour faire la guerre ou payer des
fonctionnaires. Il a l'avantage de la régularité par rapport au pillage,
au tribut exigé des peuples vaincus ou à la corvée effectuée par les
sujets. Si l'impôt a existé dès le troisième millénaire avant notre ère
en Égypte, puis en Chine, le « passage au droit » a été réalisé au
XIIIe siècle avant J.-C. Le pharaon a nommé deux juges pour lutter
