Introduction au droit
XVIIIe siècle, la notion de constitution a pu apparaître comme un
gage de pérennité. Cela n'a pas été forcément le cas, mais son
usage a été progressivement généralisé à l'ensemble du monde.
* Des règles de dévolution et d'organisation du pouvoir politique
Le pouvoir politique naît d'abord de la force militaire et de la
richesse. Il se réclame alors d'une origine divine10. Des règles de
dévolution du pouvoir ont été forgées pour donner au pouvoir une
origine légale, faisant intervenir les gouvernés.
L'élection permet aux électeurs de choisir les gouvernants : ainsi,
au VIIIe siècle avant J.-C., les aristocrates grecs, propriétaires fonciers, imposèrent au roi d'être élu par eux. Après la fin de la royauté,
l'élection permit de désigner des magistrats, chargés de fonctions
publiques de direction, pour une durée limitée. En France, jusqu'à
Philippe-Auguste au XIIIe siècle, le roi était l'élu des seigneurs.
On peut considérer que le pouvoir originaire appartient aux
citoyens. C'est pour lutter contre un rival que Clisthène, de 507 à 501
avant J.-C, dépourvu de toute fonction dirigeante, fit attribuer le pouvoir politique aux citoyens d'Athènes11. Étaient citoyens les hommes
de plus de dix-huit ans nés d'un père athénien. C'était la loi qui définissait cette qualité de citoyen. Une loi de 451 en modifia les conditions d'attribution, exigeant que la mère fût également athénienne.
À Athènes, le tirage au sort des magistrats parmi les citoyens fut
une forme de dévolution du pouvoir, permettant de s'assurer que
celui-ci ne serait pas confisqué, mais serait exercé par l'ensemble
des citoyens.
En France, au Moyen Âge, une théorie statutaire de la couronne
assujettit sa dévolution à des lois fondamentales, en réalité
coutumières12. La loi salique fut créée pour que le roi d'Angleterre
ne puisse accéder au trône de France.
Dès lors que des règles commandent la dévolution du pouvoir,
elles permettent aussi le retrait des fonctions politiques. Athènes
multiplia les contrôles permettant aux citoyens de mettre en jeu la
responsabilité politique des dirigeants. Ceux-ci risquaient le bannissement, voire la peine de mort ou, à défaut, une forte amende,
comme Périclès en 430 avant J.-C. Au XVIIIe siècle l'Angleterre
trouva le moyen de mettre en jeu la responsabilité politique des
