Les objets du droit
ministres, le Parlement les obligeant à démissionner, sans devoir
prouver l'existence d'une faute pénale.
Les règles d'organisation du pouvoir permettent de répartir les
fonctions politiques entre plusieurs magistrats ou institutions. À
Athènes, du VIe au IVe siècle avant J.-C., la fonction législative était
exercée par une Assemblée de citoyens. La fonction exécutive était
exercée par des magistrats. Ceux-ci pouvaient avoir des fonctions
spécifiques : les stratèges étaient chargés de la conduite des opérations militaires, les trésoriers des finances, etc. La fonction judiciaire était confiée à un tribunal composé de citoyens.
En France, au cours des derniers siècles de l'Ancien Régime, la
royauté a tout fait pour être « absolue », et réduire à néant des pouvoirs qui appartenaient à d'autres qu'elle : états généraux, assemblées de notables, états provinciaux, administrations des villes...13
Une constitution fut réclamée pour mettre fin à cet absolutisme.
* Une constitution
À la fin du XVIIIe siècle, une constitution sembla nécessaire pour
fonder un nouveau pouvoir et limiter le pouvoir royal. Les États-Unis
montrèrent la voie en 1787, suivis par la France, en 1791, puis par
les autres États européens au cours du XIXe siècle. Au XXe siècle,
pratiquement tous les États du monde ont une constitution. La
France est régie par la Constitution du 4 octobre 1958.
Les constitutions ne sont ni forcément pérennes, ni forcément
démocratiques, mais leur objet est particulier14. La constitution est
une tentative sans cesse renouvelée d'organiser, pour le limiter, le
pouvoir politique.
Cet objet est défini par la Déclaration des droits de l'homme et du
citoyen du 26 août 1789 : « toute société dans laquelle la garantie des
droits n'est pas assurée ni la séparation des pouvoirs déterminée,
n'a point de Constitution » (art. 16).
La séparation des pouvoirs est la distinction de plusieurs fonctions
de nature politique, exercées pour la gestion de la cité, et leur attribution à plusieurs organes ou personnes. C'est un principe de bon
sens, énoncé par Montesquieu comme par Rousseau : il ne faut
pas remettre tous les pouvoirs à un même individu ou un même
groupe d'individus, faute de quoi « il n'y a point de liberté ».
