Les objets du droit
Dans un deuxième sens, le droit civil est le tronc commun du
droit privé, qui concerne les relations entre les personnes privées :
relations familiales, droit de propriété qui s'impose aux autres personnes, obligations des personnes les unes envers les autres.
Si on peut trouver des règles de droit civil anciennes, c'est le
droit romain qui a construit un système de droit privé.
Déjà la plus longue partie du Code de Hammourabi, souverain de
Babylone de 1792 à 1750 av. J.-C., concerne les affaires familiales -
relations entre époux, relations entre parents et enfants - : « § 141 :
Si l'épouse de quelqu'un, qui demeure dans la maison de ce dernier,
s'avisant de traîner dehors se constitue une réserve, dilapide sa
maison et néglige son mari, on la confondra et si son mari a déclaré
qu'il voulait la répudier, il pourra la répudier ; rien ne lui sera donné,
ni pour (frais de) déplacement ni comme indemnité de
répudiation ». D'autres dispositions garantissent les droits des propriétaires sur leurs biens matériels... et leurs esclaves.
La Rome classique, du IIIe siècle avant J.-C. au IIIe siècle après
J.-C., a défini les concepts du droit privé et apporté des réponses
qui structurent encore le droit moderne. Les questions abordées
par les juristes romains concernent les personnes, leur patrimoine
et leurs obligations15. La question des personnes implique une définition du sujet de droit, un encadrement juridique du mariage et de
la filiation, la protection des incapables, l'élaboration d'un droit des
successions et des donations. La définition juridique du patrimoine
suppose une classification des choses et débouche sur la distinction
entre possession et propriété et la protection de la propriété. La
notion d'obligation au sens juridique est construite et une distinction
est faite entre obligations conventionnelles et délictuelles. L'exécution des obligations et leurs garanties sont précisées.
En France, le « Code civil des Français » a, en 1804, unifié et étatisé le droit privé, formé auparavant du droit romain et des coutumes
territoriales16. Napoléon voulait consolider l'héritage révolutionnaire,
mais ce fut une « œuvre de transaction »17 : le Code est fondé sur
l'égalité des droits, contrairement à la société féodale. Mais il a un
versant autoritaire : il donne le pouvoir au mari, au père, au patron.
Parallèlement, il garantit le droit de propriété des nouveaux propriétaires, paysans libérés des droits féodaux ou acquéreurs des biens
