« La plupart des dispositions du Code civil s'adressent à des
notables »18.
Napoléon imposa le Code civil aux pays conquis, de la Belgique à
l'Italie, voulant en faire « le droit commun de l'Europe »19. Hors d'Europe, le Code civil servit de modèle, jusqu'au Japon de l'ère Meiji, à
la fin du XIXe siècle.
En France, le Code civil se maintint tout au long du XIXe siècle,
par-delà la succession de régimes politiques, monarchies, républiques, empires, ne subissant que des retouches ponctuelles, apportées, un peu par des lois, davantage par la jurisprudence et la doctrine. La flexibilité du Code civil avait été mise à son crédit, à la fin du
XIXe siècle. Cette flexibilité a pu jouer dans des sens opposés, certains considérant que « le libéralisme économique a été battu en
brèche »20, d'autres que « l'absolutisme du droit de propriété » a été
accentué21, spécialement par la doctrine. Dès la fin du XIXe siècle,
l'article 1382, qui établit une responsabilité pour faute, fut interprété
par la Cour de cassation pour admettre une responsabilité en
dehors de toute faute.
À partir de la seconde moitié du XXe siècle, des pans entiers du
code firent l'objet de réformes législatives. Après que la puissance
maritale est supprimée en 1938, le droit de la famille est modifié
de fond en comble à partir de 1964, pour donner des droits aux femmes, aux enfants, aux individus : réforme des régimes matrimoniaux, substitution de l'autorité parentale à la puissance paternelle,
droit au respect de la vie privée, droits des enfants naturels, réforme
du divorce, institution du pacte civil de solidarité, puis du mariage
entre personnes de même sexe. Le Code civil fait place également
à de nouveaux droits en matière de bioéthique, pour tenir compte,
notamment, des avancées médicales dans le domaine de la procréation.
Ce n'est qu'au XXIe siècle que le droit des obligations connaît une
grande réforme, apportée par une ordonnance du 10 février 2016
« portant réforme du droit des contrats, du régime général et de la
preuve des obligations ». Alors que cette réforme était attendue
depuis un demi-siècle, son adoption fut précipitée par la perspective
