de l'affaire, mais ne participe plus au délibéré.
C. Les libertés publiques
Alors que la Révolution avait déclaré solennellement les « droits
de l'homme et du citoyen », en tant que « but de toute institution
politique », le XIXe siècle fit plus modestement des « libertés publiques » une limitation du pouvoir politique. Le terme fut utilisé par
des juristes libéraux traditionnalistes, à la suite de Chateaubriand35.
La Constitution du 14 janvier 1852, qui fonda le Second Empire, fit du
Sénat le « gardien des libertés publiques ».
Sous la IIIe République, les professeurs de droit l'enseignèrent
comme une partie du droit constitutionnel ou du droit administratif.
Un cours de libertés publiques fut inscrit dans le programme de la
licence en droit en 1954.
Les libertés publiques touchent à tous les domaines du droit. On
pourrait penser que ce qualificatif les distingue des libertés individuelles. Tel n'est pas le cas. Les libertés sont des libertés exercées
individuellement comme la liberté d'aller et venir, la liberté d'opinion, la liberté d'expression, le droit de propriété. Ce sont aussi des
libertés exercées de façon collective, comme la liberté d'association
ou la liberté de réunion. Ce sont aussi des libertés qui ont une finalité politique comme le droit de vote. Elles comprennent également,
à partir de la fin du XIXe siècle des droits exercés dans le cadre du
travail salarié : droit de grève et liberté syndicale. La Constitution de
1791 avait prévu la création d'un « établissement général de secours
publics » et « une instruction publique commune ». À la fin du
XIXe siècle, des droits « sociaux » ont été mis en œuvre : ils obligent
la collectivité publique à mettre en place des moyens de combattre
les inégalités sociales. Ces moyens se sont développés après la
Seconde Guerre mondiale.
À la fin du XIXe siècle, la IIIe République fonda les libertés publiques sur la loi, en pratique et en théorie. Les libertés devinrent
effectives grâce à des lois toujours en vigueur (liberté de la presse
en 1881, liberté de réunion en 1881, droit à l'éducation en 1881-1886,
liberté syndicale en 1884, droits de la défense en 1897, liberté d'association en 1901). Et la doctrine juridique en fit un principe. Selon
elle, non seulement c'est la loi qui fonde les libertés, ce qui
