s'explique par l'absence d'une constitution précédée d'une déclaration des droits, mais encore c'est la loi qui peut en définir les
limites36. Et ces limites sont inhérentes à la notion de liberté
publique. C'est l'application de l'article 4 de la Déclaration de
178937. Quant à la procédure, c'est l'application du principe démocratique. Et au fond, il revient d'abord au législateur puis aux juges,
qui appliquent la loi, d'apprécier dans quelle mesure il est nécessaire de limiter l'exercice d'une liberté publique pour assurer la réalisation des fins d'intérêt général, notamment de l'ordre public.
Cette appréciation est subjective, variable, circonstancielle38. Le
législateur, comme les juges, peuvent donner la priorité à l'ordre,
plutôt qu'à la liberté. C'est ce qu'ils firent à la fin de la IIIe République.
Après la Deuxième Guerre mondiale, les libertés publiques trouvèrent de nouveaux champs d'application, de nouveaux fondements,
dans les constitutions et les conventions internationales, de nouvelles dénominations (droits de l'homme, libertés et droits fondamentaux), mais le régime juridique de leurs limitations resta.

Après la Deuxième Guerre mondiale
A. Internationalisation
La Deuxième Guerre mondiale a été la manifestation paroxystique des ravages causés par le nationalisme. Après qu'elle a pris
fin, des systèmes juridiques nouveaux furent créés pour empêcher
le retour de telles infamies. Ils s'inscrivirent dans le cadre universel
et dans le cadre européen.
À la fin du XXe siècle, à partir des années 1990, la mondialisation
est un nouveau facteur de transformation des relations internationales : elle concerne non seulement les échanges économiques mais
aussi les défis, climatiques et économiques, auxquels est confrontée
la planète dans son ensemble.
