Caracalla avait défini une unité sociale, celle de tous les habitants de
l'Empire romain, en décidant qu'ils étaient tous citoyens de l'Empire,
avec les mêmes droits et les mêmes obligations. L'État moderne est
devenu l'expression de cette unité.
Si le droit définit une communauté, il en dessine les contours, les
caractéristiques... et en exclut ceux qui ne présentent pas ces caractéristiques. Le droit est aussi exclusion. Le droit athénien au Ve siècle avant J.-C., comme le droit romain, exclut ceux qui ne sont pas
citoyens, c'est-à-dire membres de la cité : les esclaves, les métèques, ou étrangers, les femmes. L'Ancien droit français excluait les
aubains, c'est-à-dire les étrangers, les bâtards, les lépreux, les noncatholiques, les esclaves des colonies10. Aujourd'hui les États distinguent entre nationaux et étrangers. Ces derniers peuvent être admis
à résider sur le territoire de l'État, ils n'en ont pas le droit.
2. Le droit est-il un outil de maintien d'un ordre social ou de son
évolution ? - Le droit va dans le sens du conservatisme social dans
la mesure où il est fait par ceux qui en ont le pouvoir, afin d'inscrire
dans la durée un rapport de forces. Mais contrairement aux tables
de la loi d'origine divine, donc intangibles, le droit d'origine humaine
peut être modifié à la suite de l'évolution des rapports de forces et
des combinaisons sociales. Dès lors il n'est que le rempart fragile
de groupes sociaux qui sont encore compétents pour construire
des digues juridiques, mais n'ont plus la force de les défendre11.
Le droit devient une « ressource » pour ceux qui bousculent l'ordre établi12. Ces ressources sont la reconnaissance des droits de
tous et de chacun comme le recours au juge pour les faire respecter.
3. Le droit a un rôle économique. - L'analyse économique du
droit s'est développée à partir de la seconde moitié du XXe aux
États-Unis, puis en Europe. Elle analyse le droit sous l'angle de son
efficience13.
Il est d'emblée clair que les réglementations publiques de la gestion des ressources ont une fin économique. Tel fut le cas de la
réglementation de la ressource des fleuves en Mésopotamie et en
