spécialement pour leur rémunération, comme ils ont pu l'être sous
l'Ancien Régime.
Ce droit a été garanti par la Convention européenne des droits de
l'homme, en 1950, par la Convention américaine relative aux droits
de l'homme, en 1969. Mais le président de la Cour suprême populaire chinoise explique à des magistrats, réunis en janvier 2017 :
« Nous devons fermement nous tenir à distance des pensées occidentales erronées comme la "séparation des pouvoirs" et "l'indépendance de la magistrature" »4.
2. Sa mise en œuvre
Il faut considérer plusieurs paramètres. Le premier est la distinction entre juges et magistrats du ministère public. La justice,
en tant que fonction judiciaire, fait intervenir des magistrats, terme
aujourd'hui utilisé pour désigner non plus les dirigeants politiques,
comme dans l'Antiquité, mais les professionnels de la fonction judiciaire. Ces magistrats se divisent en deux catégories : les juges proprement dits, qui rendent la justice, prononcent des jugements, et
les membres du ministère public. Celui-ci peut avoir différentes
fonctions qui concourent à la préparation du jugement : dans tous
les systèmes de justice pénale, il décide des « poursuites », c'est-àdire de saisir un tribunal afin qu'il puisse punir le coupable. Dans
certains cas, il dirige l'enquête préalable et peut décider d'autres
mesures5. Le ministère public a toujours un rôle dans la justice
pénale. Il intervient parfois dans la justice civile. Le pouvoir politique
peut, dans certains pays, vouloir encore contrôler, par ces magistrats, la mise en œuvre de l'action publique.
Un deuxième paramètre concerne la nature de l'indépendance.
Elle peut être organique ou fonctionnelle. D'un point de vue organique, les juges ne doivent pas dépendre quant à leur désignation
et à leur maintien en fonction du pouvoir politique. D'un point de
vue fonctionnel, les juges doivent prendre leur décision sans subir
de pressions extérieures, notamment politiques. L'indépendance
organique est une garantie de l'indépendance fonctionnelle. Mais
