compétentes pour juger les actes de la puissance publique ellemême, peuvent en être séparées, comme en France.
Au XXe siècle, de nouvelles juridictions se sont spécialisées. L'Allemagne d'après 1945 connaît cinq ordres de juridictions : la juridiction ordinaire (civile et pénale), la juridiction administrative, la juridiction fiscale, la juridiction sociale et la juridiction du travail18.
L'Angleterre était le modèle de l'absence de juridiction administrative. Au XXe siècle, elle a créé des quasi-juridictions spécialisées
dans des affaires administratives, les Administrative Tribunals,
regroupés par une loi en 2007.
Au XXe siècle encore, un nouveau type de juridiction s'est
répandu : la juridiction constitutionnelle. On a vu que le contrôle de
constitutionnalité des lois avait été exercé aux États-Unis à partir du
début du XIXe siècle. Toutes les juridictions peuvent y procéder. En
Europe, une première juridiction spécialisée a été créée par la
Constitution autrichienne de 1920. Ce modèle a été suivi par presque
tous les États européens après la Deuxième Guerre mondiale. La
Cour constitutionnelle allemande est compétente non seulement
pour juger de la constitutionnalité des lois, mais aussi pour sanctionner la violation de la Constitution commise par un acte administratif ou un jugement.
Au sein de chaque ordre de juridiction, une nouvelle répartition
peut être faite en fonction de l'importance de l'affaire jugée. Ainsi
les infractions pénales sont jugées par des juridictions différentes
selon leur gravité. Il en est souvent de même pour les affaires civiles, selon le montant en litige.
Cette répartition est dictée par un souci de rapprocher la justice
des justiciables, ce qui correspond à un maillage territorial.
2. Un maillage territorial
La justice royale pouvait être itinérante. En Angleterre, encore
aujourd'hui, les juges de la Couronne sont des juges itinérants. Ils
rendent la justice dans plusieurs villes. Mais généralement, les juridictions ont un siège territorial. Il appartient à chaque État d'établir
une carte judiciaire. La répartition des juridictions sur le territoire
est fonction de l'histoire et de la géographie de chaque État. Elle
peut faire l'objet d'un compromis plus ou moins stable. En Italie, la
question de la répartition géographique des tribunaux fait l'objet de
discussions depuis l'unification du pays en 1861.
