L'obligation conditionnelle Section 1. Conditional obligations Art. 1304. - L'obligation est conditionnelle lorsqu'elle dépend d'un événement futur et incertain. Art. 1304. - An obligation is conditional where it depends on a future, uncertain event. La condition est suspensive lorsque son accomplissement rend l'obligation pure et simple. A condition is suspensive where its fulfilment renders the obligation unconditional. Elle est résolutoire lorsque son accomplissement entraîne l'anéantissement de l'obligation. It is resolutory where its fulfilment results in the destruction of the obligation. Art. 1304-1. - La condition doit être licite. À défaut, l'obligation est nulle. Art. 1304-1. - A condition must be lawful. If it is not, the obligation is a nullity. Art. 1304-2. - Est nulle l'obligation contractée sous une condition dont la réalisation dépend de la seule volonté du débiteur. Cette nullité ne peut être invoquée lorsque l'obligation a été exécutée en connaissance de cause. Art. 1304-2. - An obligation undertaken subject to a condition whose satisfaction depends on the will of the debtor alone is a nullity. Nullity on this ground cannot be invoked where the obligation has been performed while aware of the position. Art. 1304-3. - La condition suspensive est réputée accomplie si celui qui y avait intérêt en a empêché l'accomplissement. Art. 1304-3. - A suspensive condition is deemed to have been fulfilled if the party who is interested in its failing has obstructed its fulfilment. La condition résolutoire est réputée défaillie si son accomplissement a été provoqué par la partie qui y avait intérêt. A resolutory condition is deemed to have failed if its fulfilment has been caused by the party who had an interest in this occurring. Art. 1304-4. - Une partie est libre de renoncer à la condition stipulée dans son intérêt exclusif, tant que celle-ci n'est pas accomplie ou n'a pas défailli. Art. 1304-4. - A party is free to renounce a condition which has been stipulated for his exclusive benefit, as long as the condition has not been fulfilled or has not failed. 494
