La déstabilisation de l'impôt

connu : celui d'un foisonnement de « niches fiscales ». Or un examen plus attentif permet de constater également une certaine appropriation de la fiscalité avec ce que l'on appelle la fiscalité affectée9.
Celle-ci concerne de très nombreux domaines, secteur social, secteur de la formation professionnelle
et de l'emploi, organismes consulaires, secteur de
l'équipement, du logement, des transports, de l'urbanisme, de l'agriculture, de l'industrie, du commerce et de l'artisanat, de l'environnement, de la
culture, etc., sans compter les impôts locaux et
sociaux. Une telle situation est liée à une caractéristique des sociétés contemporaines, qui est leur
diversification et leur constitution en réseaux faits
de communautés d'intérêts aussi bien anciennes
que nouvelles. Cette diversification qui pèse lourdement sur la configuration prise ces dernières années
par les prélèvements obligatoires fait que la complexité fiscale n'a d'égale que la complexité politique,
économique et sociale, et, plus exactement qu'elle
tend à lui correspondre trait pour trait.
C'est dans ce cadre que le pouvoir fiscal tend à
éclater en étant devenu un enjeu particulièrement
fort pour les multiples centres de décision publics
et privés qui forment maintenant le tissu de la
société, tandis qu'il est de moins en moins l'attribut
d'un pouvoir universel représenté jusqu'alors par un
