prenant effet au jour des dernières nouvelles. Pendant cette période,
l'absent est présumé être toujours vivant : le mariage n'est pas dissous, sa succession n'est pas ouverte et il reste à la tête de ses
biens. Diverses dispositions à finalité essentiellement patrimoniale
permettront de protéger les intérêts de l'absent en organisant la
gestion de son patrimoine (v. par ex. C. civ., art. 113 et la représentation de l'absent dans l'accomplissement des actes conservatoires
et d'administration sur les biens ; de même si l'absent est marié les
règles des régimes matrimoniaux permettront à l'époux de se faire
autoriser en justice à passer seul les actes pour lesquels le consentement du conjoint absent aurait été nécessaire).
Quand la disparition de la personne devient une hypothèse vraisemblable, voire probable, le TGI peut rendre un jugement déclaratif
d'absence, soit après 10 ans quand les proches ont fait constater
l'absence, soit après 20 ans dans le cas inverse. Ce jugement
emportera tous les effets d'un décès.
Le retour à la vie juridique. - En cas de réapparition de l'absent
ou du disparu le retour à la vie juridique est prévu. Dans ce cas, le
procureur de la République ou tout intéressé peut demander l'annulation du jugement déclaratif d'absence ou de disparition. La
décision d'annulation sera alors portée en marge du jugement
déclaratif et sur tous les registres y faisant référence. Pour préserver l'intérêt des tiers et des héritiers, l'absent ou le disparu ne
retrouveront toutefois leurs biens et ceux qu'ils auraient dû recueillir pendant l'absence que dans l'état où ils se trouvent au jour du
retour. Le mariage restera dissous afin d'éviter tout risque de bigamie (ex. : affaire Martin Guerre).
À côté de ces personnes physiques, le droit a reconnu des personnes morales.
2. Les personnes morales
L'existence des personnes morales. - S'il a pu longtemps paraître difficile de concevoir une personne qui ne soit pas une personne
physique, aujourd'hui l'existence des personnes morales ne fait plus
l'objet de contestations. Leur présence dans la vie juridique est quotidienne et leur utilité est reconnue.
Seule leur nature pourrait encore être discutée. Deux conceptions s'opposent : la théorie de la fiction des personnes morales et la
théorie de la réalité :
- En vertu de la théorie de la fiction, la personnalité morale ne
peut exister que si elle est reconnue par le législateur, car elle n'est
