qu'une construction intellectuelle abstraite. Seul l'État peut reconnaître l'existence d'une personne morale. De ce fait il ne peut exister
de personnes morales en dehors des hypothèses où la loi reconnaît
à un groupement la personnalité civile.
- Au contraire, selon la théorie de la réalité, il existe des groupements agissant dans la vie juridique comme une personne et qui
peuvent à ce titre être reconnus comme des sujets de droit en l'absence de loi. La deuxième chambre civile de la Cour de cassation a
consacré cette dernière théorie dans un célèbre arrêt du 28 janvier
19541. Elle a reconnu que la personnalité morale « appartient, en
principe, à tout groupement pourvu d'une possibilité d'expression collective pour la défense d'intérêts licites, dignes, par suite d'être juridiquement reconnus et protégés »2. Cette jurisprudence est constante.
La diversité des personnes morales. - Les personnes morales de
droit public sont l'État, les collectivités locales (régions, départements, communes), les établissements publics (universités, hôpitaux, services publics industriels et commerciaux comme EDFGDF).
Les personnes morales de droit privé peuvent constituer :
- soit des groupements de personnes (sociétés, associations,
groupement d'intérêt économique (GIE), syndicats professionnels) ;
- soit des groupements de biens (fondations caractérisées par
l'affectation de biens à une finalité déterminée : réalisation d'œuvres
d'intérêt général, et à but non lucratif).
Toutes ces personnes morales sont distinctes des personnes physiques ou morales qui les ont créées. Elles constituent des sujets de droit
autonomes et disposent d'un patrimoine.
II.
Les choses
Il en existe deux catégories : les biens (choses pouvant être
appropriées), les choses inappropriées (« hors du commerce »).
1. Les biens
Des objets de propriété. - Tous les biens, quels qu'ils soient,
sont considérés comme des objets de propriété : un sujet de droit
