Introduction au droit
consentement et doit émaner du cocontractant, ou par extension
d'une personne liée à lui (représentant, tiers de connivence).
La violence est la contrainte physique, morale ou économique
(abus de l'état de dépendance dans lequel se trouve un cocontractant) exercée sur un individu pour le contraindre à conclure un acte
(v. C. civ., art 1140 s.).
Il faut distinguer ces vices du consentement de la lésion qui
constitue un déséquilibre objectif dû à une disproportion manifeste
des prestations prévues dans un contrat (v. C. civ., art. 1168). Elle
peut dans certaines conditions être sanctionnée (ex. lésion de plus
des 7/12e dans la vente d'immeuble).
La reprise de la condition de capacité. - La capacité est l'aptitude d'une personne à être titulaire de droits et à les exercer. La
capacité de contracter est l'aptitude d'une personne à pouvoir valablement conclure un contrat déterminé.
La capacité des personnes physiques et ses limites : les
incapacités. - Pour les personnes physiques, la capacité est la
règle, l'incapacité l'exception. Ainsi, par principe, toute personne
physique peut contracter, sauf en cas d'incapacité prévue par la loi
(v. C. civ., art. 1146) : ce qui est le cas pour les mineurs non émancipés et les majeurs protégés.
Les mineurs non émancipés et les majeurs protégés sont affectées par une incapacité d'exercice qui leur interdit d'accomplir seules certains actes qu'elles pourraient effectuer selon les cas, en
étant représentée, assistée ou autorisée L'incapacité de contracter
est une cause de nullité relative du contrat.
Le droit reconnaît aussi les incapacités spéciales de jouissance
qui interdisent à la personne qu'elles visent d'acquérir un droit
déterminé (ex. cas du médecin qui ne peut recevoir de libéralité
d'un malade lors de sa dernière maladie, C. civ., art. 909).
La capacité des personnes morales. - Pour les personnes
morales (ex. société, association), la capacité est par principe limitée, par les règles applicables à chacune d'entre elles (liées à leur
nature, objet et forme) ce qui les empêche de conclure certains
actes juridiques. Ce principe de spécialité est aujourd'hui consacré
dans la loi (v. C. civ., art. 1145). Les personnes morales peuvent aussi
être frappées d'incapacités légales de jouissance.
La disparition de l'ancienne condition d'un objet certain. - Cette
condition devait être remplie dans les contrats conclus avant le
