AUSTRALIA'S 'CHOICE OF REPAIRER'
CAMPAIGN SEEKS MANDATORY DATASHARING LEGISLATION
THE Australian automotive aftermarket
industry has been increasingly affected
by the sophisticated technology now
available in all ranges of vehicles.
Small independent workshops are
still a vital part of the Australian
economy and more are at risk of
closure by the car manufacturers'
monopoly on the market.
Unlike in Europe and the United
States, the withholding of vehiclegenerated data and service information
by car manufacturers in Australia
is still completely legal. A voluntary
agreement entered into by leaders of
both the manufacturer and aftermarket
industries back in 2014 had no legally
binding foundation and was built on a
platform of transparency. Unfortunately,
it was made obvious within the first
12 months of the agreement the car
manufacturers were not going to
willingly make available car data for

independent workshops to access.
The only realistic way forward was the
implementation of a legally binding data
sharing code. Since then, the "Choice
of Repairer" campaign, Australia's
Right to Repair campaign, has been
a long and ceaseless process.
The release of the Australian
Competition and Consumer
Commission (ACCC) report into New
Car Retailing in December 2017
was a huge win for the independent
workshops. The report identified
the importance of independent
workshops in the aftermarket industry,
emphasizing the need for competition
and the resulting consumer benefit,
while also shedding light on the
extent of car manufacturers' behavior.
The report recommended three
options to safeguard the industry,
one of which was a mandatory
data sharing industry code.

The reality of the Australian
government adopting a mandatory
data-sharing code grows from
strength to strength, with the
opposition party announcing they
will implement a code should they
win the next election. The current
Australian government has announced
it is actively working towards a code
and it is expected that a mandatory
data sharing scheme will be ready in
Australia by the end of this year.
