conspicuously post its privacy policy on its website. Since the time of that writing, the California Attorney General has made available on its website (oag. ca.gov) a detailed publication entitled "Making Your Privacy Practices Public -Recommendations on Developing a Meaningful Privacy Policy." It notes that the Privacy Act is the first law in the nation with a broad requirement for privacy policies and is a privacy landmark and goes on to detail its recommendations with respect to privacy policies in accordance with the Privacy Act. While that publication indicates that it should not be construed as legal advice, it would seem to indicate the importance to the Attorney General of the need for Privacy Act compliant privacy policies. Further, the Attorney General has made efforts to enforce the Privacy Act through the California Unfair Competition Law, which, among other things, permits penalties of up to $2,500 per violation. The Privacy Act posting requirement is violated if the website operator fails to post its policy within 30 days after being notified of noncompliance. From recent experience, it is clear that such notification may suddenly occur, causing the need to act within the 30 day period to produce a compliant privacy policy. As an alternative to such crisis management, it is recommended that, before notification, California associations and other nonprofits develop, authorize and post a privacy policy which complies with the Privacy Act and correctly describes the particular privacy practices of the entity.
