How to stay in compliance when the
Trump administration cracks down

A

s part of his first-week initiatives, President Trump turned his focus toward immigration. These immigration
initiatives included dramatically expanding the resources of Immigration and Customs Enforcement (ICE).
Specifically, the Trump administration authorized the hiring of 10,000 ICE agents across the United States.
This increase in ICE officers will have a direct impact on employers as it relates to I-9 compliance and ICE audits of
Forms I-9. For example, it is anticipated that ICE homeland security investigations audits will increase to around
3,000 in 2017, tripling the number of audits performed in recent years.
WHAT ARE THE RISKS ASSOCIATED
WITH I-9 NON-COMPLIANCE?

The Immigration and Nationality Act
of 1965 (INA) states that an employer cannot hire an alien knowing that the person is
unauthorized to work for the employer. To
help enforce the INA's provisions, employers
must verify the identity and work authorization of each person hired after Nov. 6, 1986.
This verification process is done through the
completion of the Form I-9 and submission

of an E-Verify query if the employer is
enrolled in the program.
There is potential civil and criminal
liability associated with improper completion of the Form I-9. On the civil liability
side, employers that fail to comply with I-9
verification rules can face significant fines.
For each paperwork violation-regardless

of whether the individual completing the
Form I-9 is a U.S. citizen or an alien-an
employer's exposure ranges from $216
to $2,156 for each violation. But document violations are often the tip of the
spear when it comes to I-9 compliance.
