Entry-Level Driver Training
As expected, prior to leaving office, the Obama
administration issued two major rules of interest to
the industry. In December 2016, FMCSA published
its long-awaited Entry-Level Driving Training (ELDT)
rule. Beginning in 2020, all drivers seeking a CDL will
need to complete ELDT provided by a certified training
provider prior to taking the required CDL skills test.
The training must consist of both classroom and
behind-the-wheel elements. ATA was pleased that FMCSA
took a competency-based approach that requires driver
trainees to demonstrate proficiency in operating a CMV
in order to complete training, rather than mandate a
minimum number of hours behind the wheel. The ELDT
rule also establishes a registry of certified training
providers who will be required to electronically submit
driver ELDT completion certificates to drivers' State
Licensing Agencies.
Drug Clearinghouse
Also in December, FMCSA finalized a rule establishing
a national clearinghouse for positive drug and alcohol
test results for CDL holders. The rule requires motor
carrier employers, medical review officers, third party
administrators and substance abuse professionals to
submit records to the clearinghouse, including positive
test results, refusals to test, negative return to duty tests
and traffic citations for driving a commercial motor vehicle
under the influence of drugs or alcohol.
In a significant win for the trucking industry, FMCSA
will require motor carriers to report all instances of
actual knowledge of drug or alcohol use in addition
to test failures or refusals to test. Motor carriers
will be required to query the clearinghouse prior to
hiring a driver and to perform an annual check of their
existing driver workforce. If a carrier finds that a driver
had tested positive or refused to test, the employer
would need to verify that the driver had successfully
completed the mandatory substance abuse professional
referral, evaluation and treatment process. The current

requirement for employers to query past employers for
drug testing record checks will be phased out three years
after the rule's compliance date of January 6, 2020.
New Regulations Freeze
With the recent change in presidential administrations,
shippers and carriers alike will see a shift in executive
branch and agency priorities. In one of his first actions
upon taking office, President Trump issued a freeze -
similar to ones issued by prior incoming administrations
- on all new regulations from all federal departments and
agencies until approved by a department head or official
appointed by the president. For regulations that were
published in the Federal Register but had not yet gone
into effect prior to January 20, 2017, the order extends the
effective date by an additional 60 days to give the new
administration time to review the regulation.
Electronic Logging Devices
One rule that won't be impacted by the regulatory freeze in
2017 is the implementation of the Electronic Logging Device
(ELD) mandate. Beginning December 18, 2017, drivers
currently required to maintain paper records of duty status
(with some limited exceptions) must begin using ELDs.
This will be a significant change for many drivers and
carriers. However, it is a change that will go a long way
toward improving compliance with federal hours-of-service
rules and allow drivers to devote time previously
dedicated to maintaining paper logs to driving and other
essential duties.
Drivers and carriers currently using Automatic Onboard
Recording Devices (older devices not necessarily meeting
the ELD rule's new standards and specifications) will have
until December 16, 2019, to purchase compliant ELDs or
upgrade their technology to meet the ELD requirements.
However, for carriers and drivers new to electronic logs,
the clock is ticking, so they should be reviewing the rule's
requirements and begin examining their options for
compliance as soon as possible.
