Electronic Logging Devices:
Myths and Facts

Despite evidence to the contrary, there
continues to be a persistent belief that
ELDs will not improve highway safety.
In fact, however, electronic logs have
demonstrated safety benefits. A 2014
study conducted by FMCSA found that
trucks equipped with electronic recorders
had a lower overall crash rate and lower
preventable crash rate than trucks that
did not. In addition, trucks with recording
technology had 53 percent lower drivingrelated hours of service violation rates than
trucks not equipped with the recorders1.

integration into fleet management systems
have helped lower the expected costs
significantly. The rule also permits drivers
to use smartphones and tablets as ELDs,
which will also help keep costs down for
carriers and drivers. Furthermore, because
ELDs create electronic records that will
more accurately track driving time, fleets
and drivers will realize savings by reducing
form and manner errors and Hours-ofService violations. In addition, while
paper logs require drivers to round up to
the nearest 15 minutes, ELDs record drive
time down to the minute, allowing drivers
additional time on the road.

ELDs will allow the government
to constantly monitor a driver's
location.

This just isn't so. FMCSA actually instituted
strict technical limits on how precise a
driver's location can be captured by the ELD
for purposes of law enforcement. When a
driver is in on-duty driving status, the rule
limits location precision accuracy to a onemile radius. The radius is further expanded
to 10 miles when a driver is operating
the vehicle for personal conveyance.
Furthermore, ELDs will not automatically
report Hours-of-Service violations to law
enforcement agencies. Big Brother, this is
not.

Myth #4:

ELDs will lead to increased
harassment of drivers.

FMCSA included a number of provisions
designed to prevent and punish instances
of harassment. For example, the rule
explicitly prohibits information derived from
an ELD from being used to harass a driver,
creates a procedure for drivers to file written
complaints and establishes civil penalties
for harassment. The rule also requires that
ELDs either have a mute function or allow a
driver to turn off the volume when he or she
enters into sleeper berth status. To guard
against manipulation of a driver's records,
the rule requires ELDs to retain the original
record that was generated, and requires
drivers to approve any edits to ELD records
made by motor carriers. ATA believes that
the final rule is a reasonable and balanced
approach that satisfies Congress's mandate
for ELD adoption while ensuring against
driver harassment. ■
