Cutting off disability coverage (or any other coverage) during the common law notice period may effectively make the employer the insurer. Several recent cases have confirmed that just because your insurer will not continue coverage after an employee is let go, that does not relieve you, the employer, of your legal obligation. The best way to protect yourself from this liability is to address it up front by including clear language in the employment agreement which provides that disability coverage will end at the conclusion of the statutory notice period. If it is too late to do so, and you are unable to obtain a full and final release from the employee before disability coverage ceases, you should consider arranging alternative coverage for the employee, so that you do not become the insurer and expose yourself to substantial liability if they become disabled. most are the ones where we work together so that we can understand the nature of the client's business, their concerns and their goals.
