BILL 17 AND
YOUR BENEFIT
PLANS

On May 24, 2017, the first reading of Bill 17
occurred in the Alberta Legislature. The
Fair and Family-Friendly Workplaces
Act (the "Bill"), proposed a number of
important amendments to Alberta's
Employment Standards Code (ESC) and
Labour Relations Code (LRC) in an effort
to modernize provincial workplace law.
Employers must now consider the significant impact on policies, practices and
their businesses. Most changes will come
in to effect January 1, 2018; as such you
should review existing policies and start to
plan how you will incorporate the legislation into your business practices.

CONSIDERATIONS FOR
BENEFIT PROGRAMS
1. Unpaid Protected Leave Period
With the reduction in the protected
leave eligibility period from 1 year to

90 days, employers should evaluate the
impact to disability plan waiting and eligibility periods. Contract and internal
disability policy will need to be contemplated as it relates to this change.
2. Compressed Work Weeks
Employers and employees will be
allowed to agree to average work hours
over a period of 1 to 12 weeks for the purpose of determining overtime eligibility.
Work weeks may also be compressed as
part of these agreements. This may have
impact to the process applied in group
disability and life insurance programs
for the purpose of calculating income
during a period of disability.
3. New Leaves of Absence
The introduction of long-term injury
and illness leave for a maximum of
16 weeks in a calendar year (with a
medical certificate requirement) will
require contemplation in relation to

disability claim eligibility. Policy should
be considered to manage differences
between protected leave and disability
claim requirements.
4. Lay Off Periods
Once the possibility of an indefinite
temporary layoff has been eliminated
and the requirement of layoffs to be
limited to 60 days within a 120-day
period is applied, employers will want
to ensure that benefit plan contract
language aligns. Benefits eligibility
during a period of temporary layoff
is often specifically stated in benefits
contracts and should be contemplated
with this legislative change. Under the
legislation, layoffs can be extended if
wages and/or benefits are paid and
the employee agrees.
5. Benefit Coverage & Pension Accrual
Though the new legislative changes
will align Alberta with (and in some
