which for aircraft ﬁnanciers affords lender
protections on par with the U.S. Bankruptcy
Code in nations properly adopting the treaty
and its protocols. For operators, Cape Town can
mean discounts for export credit borrowing as
well. The treaty’s adoption is seen as key to
the growth of the so-called “international” variant of Enhanced Equipment Trust Certiﬁcates
(EETCs), the capital markets bond structuring
that has served U.S. carriers since the mid1990s and whose use continues to increase.
The ﬁrst global EETCs have been issued and
more are expected to follow.
The list of nations initially ratifying the
treaty has topped 50, with 46 of those
being mostly or fully compliant with treaty
protocols (see Chart 4: Current Status of
Cape Town Convention). “Much of that
progress is the result of the good work done
by the Aviation Working Group, which has
emerged as our industry’s voice in driving
and enhancing the regulatory framework in
which we can do effective aircraft ﬁnancing
and investment,” Boeing’s Zolotusky said.

Town Convention on Mobile Assets. The treaty provides aircraft lenders in nations ratifying it with
