GAO RECOMMENDS NEW SOURCE
SELECTION FOR NGJ

with the Navy to ensure a fair and open
evaluation of our proposal for this important program."
The TD contract covers maturation
and demonstration of critical technology elements to technology readiness level (TRL) 6, system design in preparation
for a preliminary design review, as well
as refinement of technology tradeoffs
to improve affordability, system efficiency, and host-platform compatibility.
Although the TD phase was expected
to be completed by May of 2015, with
the mid-band NGJ capability planned
for an earliest-possible delivery to the
fleet in FY2020, work was immediately
stopped on the program following the
protest, and the schedule is now up in
the air pending a decision by the Navy
on how, and when, it will proceed.
In an interview conducted during
the work stoppage but prior to the GAO's
determination, Captain John Green,
Program Manager for NAVAIR Airborne
Electronic Attack Systems and EA-6B
(PMA-234), said that he was still cautiously optimistic about maintaining
the Increment 1 deployment schedule,
observing that "because of the huge investment we made during the 33-month
[Technology Maturation] phase, where

we got even further than we had initially expected in terms of maturing the
technology, it was envisioned that the
TD phase would end up being a relatively short phase (right now scoped at 22
months). Once we turn the TD back on,
we feel we've kind of greased the skids
on the integration." Now, however, with
the GAO guidance to redo the source selection, that may no longer be realistic.
It's also not clear whether the schedule originally planned for the parallel
contract awarded to Boeing Co. (St. Louis, MO) for development and delivery of
the EA-18G aircraft modification needed
for the TD-integration stage of the NGJ
program will be impacted.
Meanwhile, in other ongoing NGJ
work, the Navy Surface Warfare Center
(Crane, IN) has now released a statement of work (SOW) package for NGJ Increment 2 low-band Concept Exploration
Studies (CES).
Overall, the NGJ program is being conducted in three capability increments,
with each increment providing an AEA
capability within specific "bands" of
coverage. Increment 1 provides for the
"Mid-band" capability, while followon increments are to provide for "lowband" (Increment 2) and "high-band"
(Increment 3) coverage.

Last month (November 13), the US
Government Accountability Office (GAO)
upheld portions of a protest filed against
the awarding of the Technology Development (TD) phase contract for the US
Navy's Next Generation Jammer (NGJ)
program. NGJ is the Navy's next-generation system for airborne electronic attack, replacing the existing AN/ALQ-99
Tactical Jamming System (TJS) pods on
the EA-18 Growler aircraft.
Following a two-year technology
maturation (TM) effort, Naval Air Systems Command (NAVAIR) in July, had
awarded a single $279.4 million TD contract for the Increment I (mid-band)
portion of the NGJ program to Raytheon
Company (Waltham, MA), over competitors BAE Systems (Nashua, NH) and a
team of Northrop Grumman (Bethpage,
NY) and Exelis (Clifton, NJ). However,
BAE Systems immediately challenged
the award.
According to a statement from Ralph
O. White, Managing Associate General
Counsel for Procurement Law at GAO,
"GAO sustained BAE's protest on the
basis that the Navy failed to reasonably
evaluate technical risk in accordance
with the terms of the solicitation, failed
to adequately document its evaluation,
and improperly credited the awardee
with outdated experience." According to
White, BAE made additional allegations
in the protest, but these were denied.
As a result, GAO has recommended
that the Navy "re-evaluate proposals
and properly document the evaluation
record," and at the conclusion of this
work, that it "make a new source selection decision, and document its cost/
technical tradeoff analysis with the rationale for the decision."
Following the GAO's announcement,
BAE released a statement noting that
the company had protested the award
based on concerns with the Navy's
evaluation of its offering and that "we
are pleased that the GAO has sustained
