CONGRESS PASSES 2016 DEFENSE AUTHORIZATION

Following President Barack Obama's October veto of the
previous version, last month Congress passed a revised version
of the FY 2016 National Defense Authorization Act (NDAA).
As this issue of JED went to press, the President was expected
to sign the new version in the last week of November.
One notable item in the defense bill is a provision to essentially eliminate the Joint Improvised-Threat Defeat Agency
(JIDA) - the recent successor of the Joint IED Defeat Organization (JIEDDO) - as a stand-alone agency. The bill requires
that the agency's functions be transitioned to fall under an
existing agency or agencies within the Pentagon - and not
necessarily as a whole. The bill makes separate mention of
transitioning the agency's research, development and acquisition activities and the Counter-Improvised Explosive Device
Operations/Intelligence Integration Center to existing Pentagon agencies. And the funding is on the line - if a transition
plan for the agency isn't submitted by September 30, 2016 then
the money, other than what's required for current operations,
will be withheld.
With the transition, overall funding will be moved from the
Joint IED Defeat Fund to a "successor" fund, but it's not clear
how those funds might be parceled out to other agencies to
continue to support an IED defeat mission, other than the bill
specifies that up to $30 million can be committed to training
foreign security forces in IED defeat. Conference notes on the
NDAA showed that both House and Senate members expressed
major concerns about the creation of the new JIDA as an independent agency. The goal of this new plan is to "create reduced
overhead management costs while maintaining institutional
core knowledge for counter defeat and detection capabilities for IEDs and other improvised threats." At its
height, JIEDDO commanded an IED-defeat budget of
nearly $4 billion. The FY 2016 NDAA includes just over
$400 million for joint IED defeat.
Other highlights from the FY 2016 Defense
Authorization:
*	 Acquisition Reform: The bill attempts to streamline the US acquisition process in a variety of ways,
including advancement of critical decisions, as well
as reduction in legal certifications, consolidating
reporting requirements and reforming the chain of
command for decisions. Among new creations is the
establishment of a

"middle tier" of acquisition programs that can be completed
in a period of two to five years.
*	 EC-130H Compass Call: The bill restores funding for the
Compass Call fleet, which the Air Force had requested to cut
in half. Referencing the Air Force Chief of Staff's Unfunded
Requirements list, Congress noted that the EW capabilities
provided by the Compass Call are "essential to the Air Force
to operate and win in a contested battlespace." Despite the
Unfunded Requirement listing that $75.1 million would be
necessary to fund the divestiture buy-back with another $60
million necessary for modernization, Congress approved an
additional $28.7 million for Compass Call mods (for a total of
just over $97 million), plus another $27.3 million for force
structure restoration. The same provision that prevented
the Compass Call retirement also prevents funds being used
for retirement of Joint Surveillance Target Attack Radar System and Airborne Warning and Control System aircraft.
*	 AH-64 Apache Survivability: The bill allocated more
funding to meet a US Army unfunded requirement for procurement and development of improved countermeasures
to meet an urgent operational need for protection of deployed Apaches against the latest threat. The bill added
$26 million to the budget for the Common Missile Warning
System (CMWS).
In addition, the bill restored funding for, and prohibited
the retirement of, A-10 aircraft, authorized 12 additional US
Navy F-18s and 6 additional F-35Bs for the Marine Corps, and
provided $77 million in FY16 funding for the US Air Force
Long-Range Strike Bomber. The LRSB funding also comes with
instruction to the General Accountability Office to complete
an assessment of technology challenges and cost implications.
The NDAA also included $2 million to the Office of the Secretary of Defense for a commission to assess the threat to the US
from electromagnetic pulse attack. - E. Richardson

CONGRESSMAN JOE PITTS TO RETIRE
US Rep. Joseph Pitts (R-PA), founder of the Congressional Electronic Warfare Working Group, announced last month
that he would not seek re-election in 2016. Pitts, a former
Air Force EW Officer, entered Congress in 1997 and in 1999,
founded the EW Working Group to help raise awareness of
EW issues in Congress and ensure priorities and shortfalls
