ACCOMPLISHMENTS
IN 2017 SESSION

HE N.C. GENERAL ASSEMBLY
finished up the bulk of its
2017 legislative session work
on June 30 with several items
passed that are important
to agricultural industries. During those
93 legislative days, the most significant
legislation to become law remains HB 467,
"Agricultural and Forestry Nuisance
Remedies," which we reported on in the
last issue of the NC Pork Report. There
were additional legislative accomplishments also worthy of mention.

N.C. FARM ACT OF 2017
Each year, Sen. Brent Jackson sponsors
a bill called the N.C. Farm Act, which is
a vehicle to make changes to laws and
regulations related to agriculture. This
year's bill included two swine-specific
provisions.
One provision eliminated county
zoning authority for swine farms with
600,000 pounds steady state live weight
(SSLW) or larger. That zoning authority
was given to the counties in the late
1990s and allowed counties to adopt
zoning regulations to swine farms serviced by animal waste management systems with a design capacity of 600,000
pounds SSLW or larger so long as that
zoning regulation did not "have the
effect of excluding" those swine farms
"from the entire zoning jurisdiction."
Although this law had been on the
books for many years, there was no
known incident of a county attempting
to use this law to regulate hog farms.
Additionally, it seemed impossible that
a county would be able to even conceive
of a way to further regulate a hog farm
beyond what was already in place at
the state level.
But then in late 2015, a story emerged
about an incident where a county
required a producer, when rebuilding
swine barns, to hire an attorney, seek an
updated land appraisal, get an engineer
to approve new site plans, and hold a
public hearing (that no one attended).
All of these additional, unnecessary
steps cost the producer nearly $9,000.
The county cited their authority under
the zoning law for swine farms 600,000
SSLW or larger.
