Using this example of a county
improperly attempting to use that zoning law to force additional costs on a
producer made a good argument for
repealing the law.
The second swine-specific provision in the NC Farm Act of 2017
exempted the closure of hog lagoons
from requiring the use of a professional
engineer - unless the design or installation of a spillway is necessary.
The N.C. Pork Council sought this
change in response to Soil and Water
Conservation rules that would have
required the use of a professional engineer when closing a waste impoundment for animal waste management
systems. In the past, that work has
been performed by a technical specialist in the Waste Utilization Plan/
Nutrient Management Section of
the N.C. Division of Soil and Water
Conservation.

N.C. SWINE FLOODPLAIN
BUYOUT PROGRAM
The N.C. Swine Floodplain Buyout
was created in November 1999 and to
date, the state has invested more than
$18 million to successfully buy out
43 swine operations in the 100-year
floodplain. The success of that voluntary program is indisputable: inundation mapping by the N.C. Department
of Agriculture and Consumer Services
indicates that 32 of the 43 operations
would likely have flooded last year due
to Hurricane Matthew.
As reported in the last issue of the
N.C. Pork Report, the NCPC Board of
Directors unanimously adopted a resolution supporting efforts to reestablish
the voluntary swine farm floodplain
buyout program.
Thanks to that strong support from
the industry, lawmakers included
a special provision in this year's
state budget that will allow funding
that may be used by the agriculture
department to purchase conservation
easements to close swine operations
located in the 100-year f loodplain.
While the exact dollar amount was not
specified, it is expected to be between
at least $2 million. The funding comes

from leftover budget reserves from the
N.C. Forest Service.
Additionally, the N.C. Division of Soil
and Water Conservation has applied for
a federal grant that would provide additional funding towards this effort.
