The Power of an Association EPA not to require replacement of meters pulled for servicing under new lead reduction law BY MIKE KEEGAN, NRWA ANALYST CONGRESS ENACTED THE Reduction of Lead in Drinking Water Act on January 4, 2011, amending Section 1417 of the Safe Drinking Water Act (SDWA) regarding the use and introduction into commerce of lead pipes, plumbing fittings or fixtures, solder and flux. The Act established a prospective effective date of January 4, 2014, which provided a three year timeframe for affected parties to transition to the new requirements. On May 23, 2013, The U.S. Environmental Protection Agency (EPA) released their Draft Frequently Asked Questions (FAQs) for the  Reduction  of Lead  in Drinking Water Act). The Draft FAQs express EPA’s interpretation of the statutory requirements “as of this time.” Critical for NRWA’s membership was EPA’s favorable interpretation of our main concern for implementation of this new law: that servicing of water meters would not result in that meter having to meet the new definition of lead free. On June 21, 2103, NRWA commented, on the record, in favor of this recent EPA policy as follows: The National Rural Water Association has over 28,000 small and rural community members with drinking water and/or wastewater supplies. We are writing to express our support for the U.S. Environmental Protection Agency’s (EPA) interpretation of the Reduction of Lead in Drinking Water Act (P.L 111-380). Specifically, we support the Agency’s interpretation of the Act expressed in Question 16, which will allow for the most cost-effective and reasonable implementation of the new law in small and rural communities. We believe an appropriate and consistent interpretation of the Act provides that repair, servicing, calibration and maintenance of water meters (i.e. the removal and replacement of fixtures for servicing) does not trigger the requirements of Section 1417(a) of the Act. Additionally, we urge the Agency to retain the following provision of Question 16, in the final document: “[a] meter being repaired is not independently subject to the requirements in 1417(a) because it is not being used or installed for the first time in that location.” Third Quarter 2013 • 33
