The Operation and Preservation
of Cemeteries in Ontario:
The Importance of Cemetery Care
and Maintenance Trust Fund/Accounts

T

he licensing and ongoing operation of
all Ontario cemeteries is addressed and
regulated under the
Funeral, Burial and
Cremation Services
Act, 2002 (FBCSA). The Registrar,
Bereavement Authority of Ontario (BAO),
is responsible to administer this legislation, which applies to the entire bereavement sector, i.e. funeral establishments
and funeral directors, transfer services
and transfer service sale representatives, funeral pre-planners, cemeteries, crematoriums and the related sales
representatives.
Every owner of land on which a cemetery is located and/or every cemetery
operator has the obligation to comply

with this provincial legislation. There are
legal and financial penalties for failing to
comply with the FBCSA and its associated regulations; i.e. Ontario Regulation
30/11 & 184/12.
Across Ontario, small cemetery operators are struggling to maintain their
active and inactive cemeteries as the
availability of volunteers is on the decline
and the cost of maintenance is increasing. Many of these cemeteries have been
voluntarily deeded to the local municipality as the volunteers and landowners
can no longer maintain these properties.
Some small rural cemetery boards made
up of volunteers have not realized that
sticking to traditional methods of cemetery maintenance and care will place
the financial burden off those properties
on the next generation.

The formal abandonment process to
force a municipality to accept a cemetery
is expensive, extremely time consuming
and avoidable if the cemetery boards
comply with the provisions of establishing and maintaining a care and maintenance trust fund or account (C&M). Lack
of compliance, along with the lack of
education for small cemetery operators
across Ontario, poses future financial
burdens on all the citizens of the respective municipality.
The lack of financial resources and the
subsequent resulting risk brings us to the
topic of the importance of a C&M and
the required contributions to this fund.
While the FBCSA (as of July 1, 2012)
requires a minimum contribution of $250
to the fund when an interment right for
a grave is sold and the Cemeteries Act
