* Requires a public employer provide the union with the following information for all new employees within 30 days of the
date of the employee's date of hire or by the first pay period
of the month following the hire:
❍ Employee's name, job title, department, and work location
❍ Employee's work, home, and personal cell telephone
numbers
❍ Any personal email address for the employee that the
employer has on file
❍ Employee's home address
* Requires a public employer to also provide the union with the
above listed information for all employees in the bargaining
union at least every 120 days.
* Requires the structure, time, and manner of the access
provided to the exclusive representative to be decided by
mutual agreement between the employer and the exclusive
representative.
Unlike prior versions of the mandatory orientation bill,
the language in AB 119 does not specify that the employer
pays the cost of participation by the exclusive representative, nor does it require anything specific with regard
to "release" time. Rather, the bill seems to leave those
issues up to negotiation between the parties as part of
their mutual agreement. The AB 119 also provides that the
bill is not intended to modify the scope of bargaining, and
that negotiations over access of the union representative to
new employee orientations does not "reopen" negotiations
regarding any other matters.

As the bill went into effect upon the Governor signing the bill
in June, if your district or county office does not already have
procedures in place to comply with the requirements of AB 119,
it should do so now.

NEW "AGENCY FEE" CASE PENDING BEFORE THE SUPREME COURT

The passage of AB 119 comes ahead of the Supreme Court's
potential review of Janus v. AFSCME (Janus), which asks the
Court to decide the same issue that was presented in Friedrichs.
Janus is currently pending review before the Court, which will
decide later this year if it will hear arguments in the case. If Justice
Scalia had still been on the court when Friedrichs was decided, it
was expected by many that the Court would have ruled "agency
fees" unconstitutional. Now, with Justice Neil Gorsuch, a conservative like Justice Scalia, having taken his seat on the bench, it
looks like the Court is again poised to rule that mandatory "agency
fees" are illegal, should it decide to hear Janus.
Whether or not the Court will hear the case remains to be
seen, however with AB 119, California has taken a proactive step
towards protecting the power of unions in the state.
