Le titulaire d’un mandat de gestion n’est pas habilité par
l’article 828 du Code de procédure civile à représenter le
bailleur en justice.

Aux termes de l’article 39 du décret du 20 juillet 1972
pris pour application de la loi du 2 janvier 1970, la garantie financière à laquelle est tenu l’assureur et qui
couvre le solde de trésorerie à restituer à un syndicat de
copropriétaires en cas de défaillance du syndic, suppose
l’existence d’une créance certaine, liquide et exigible.
En l’espèce, la créance déclarée dans le cadre de la liquidation du syndic n’ayant pas été vérifiée, elle ne peut
acquérir ces caractéristiques que sur production d’éléments comptables permettant d’établir la situation de
trésorerie de la copropriété aux dates concernées par
les paiements litigieux et le rapprochement de ces don-

nées avec celles figurant au grand livre comptable et sur
ses relevés bancaires. Faute de produire les relevés et
rapprochements bancaires pour chacune des sommes
litigieuses, un syndicat de copropriétaires ne rapporte
pas cette preuve. La garantie financière de l’assureur du
syndic ne saurait lui être accordée.
