Joining Wolf in praise of the new law was
Kristen Tullo, Pennsylvania State Director of the
Humane Society, who agreed that the law is "the
most comprehensive animal law passed in state
history."4
One of the canines present at the signing was
Libre, a Boston Terrier that had been discovered
sick, emaciated and close to death on a Lancaster
County farm in July of 2016. In August of 2016,
approximately one month after the investigation
began into the cause of Libre's condition,
Lancaster County District Attorney Craig Stedman
sought the suspension of the Humane Society
Police Officer who was investigating the matter,
alleging that she was exercising her authority
in a "sub-standard" fashion.5 Ultimately, Libre's
owner was charged with a summary count of
cruelty to animals for failing to provide adequate
veterinarian care for the dog. Most significantly,
Libre became the "poster dog" for the push to
reform Pennsylvania's Animal Cruelty laws and,
when the bill was finally signed into law, Libre
was there with inked paw to co-sign. (Seriously.)
Stedman noted, the new law "gives
abused animals a voice they didn't have in the
courtroom. We have a lot of cases of abuse where
people are just getting a fine, and for a lot of
people that's no big deal. They just write the
check. Now, we've got some real teeth - no pun
intended - to the laws."6
Much of the former statutory scheme
regarding Pennsylvania's Animal Cruelty statutes
has now been restructured with most of the
attention being given to five major changes:
(1) The grading and penalties applicable to
the most serious acts of animal abuse have
been increased and now include felony
violations;
(2) As before, convictions may result in the
forfeiture of animals; but, if the conviction
is for a felony, forfeiture will be mandatory;
(3) Tethering practices and the legal
presumptions that accompany those
practices are now defined and, failure to
comply may result in prosecution for abuse
ranging from summary to felony offenses;
(4) Abuse involving horses now receives the
same grading as that of dogs and cats; and,
