to the proceeding who desires to subpoena to
compel the testimony of a witness should go to
the appropriate officer of the court, in the case
of a preliminary hearing, the Magisterial District
Judge or the clerk of courts, and obtain a blank
subpoena form.20 The evolution of technology
has changed the meaning of getting a "blank
form" but each individual county should have
a process for you to obtain subpoenas from the
magisterial district judge who will be hearing
your case or the clerk of courts. Subpoenas
shall be used not only for trial, but also for
any other stage of the proceedings when a
subpoena is issuable, including preliminary
hearings.21 A subpoena in a criminal case shall
order the witness named to appear before the
court at the date, time, and place specified,
and bring any items identified or described.22
The subpoena must notify the witness what
party is requesting them to testify as well as
the identity, address and phone number of the
attorney who represents that party and applied
for the subpoena.23
A subpoena in a criminal case may be
served upon a witness in a criminal proceeding
by registered or certified mail, return receipt
requested, or by first class mail.24 Other methods
of service provided by law are also acceptable.25
The Judicial Code provides that a witness
may be compelled to testify in the county
where the subpoena is issued if the party is
served anywhere within the Commonwealth
of Pennsylvania.26 The best way to ensure a
witness is served and is attached for purposes
of testifying at the preliminary hearing is to
have your private investigator or a constable
personally serve the witness. The easiest way
to achieve this is for the process server to hand
a copy of the subpoena to the witness, so long
as the witness is a competent adult. Guidance
for unique situations such as serving minors
or incompetent individuals can be found in
the Rules of Civil Procedure.27 The advantage
to having a subpoena served personally over
having the Magisterial District Judge mail the
subpoena is that if the witness fails to show, you
will have the ability to call the individual who
made service to prove that process was properly
