OPENING
STATEMENT
I
hope you are all safe and well. While all of
our practices have been very much affected by
the pandemic, we continue to adapt and do
as much of our good work as possible under the
circumstances. So, too, does PACDL. Please allow
me to update our membership and also thank
some of our dedicated volunteers.
Through the tireless efforts of our Education
Committee and our volunteer presenters, we
are now a Pennsylvania-approved online CLE
provider. PACDL has presented 17 CLE webinars
through August covering a wide range of topics
including Compassionate Release, Immigration
Consequences, and SORNA. Check our home page
(www.pacdl.org) to see the current CLE webinars,
meetings and events, which are scheduled
through November. You can easily register
through the web site. Our White Collar Practice
Seminar will be held virtually November 19 and
20 - a first for PACDL. Registration for the best
white collar practice seminar in the region opens
October 1.
Our NexGen Committee, led by Caroline Donato,
in addition to hosting a series of webinars, also
collaborated on a thoughtful and detailed letter
to the Pennsylvania Board of Law Examiners
advocating for a remote and safe Bar Exam in
light of the COVID-19 pandemic. The Committee
is also coordinating a large group admission on
December 14 to the bar of the Supreme Court of

the United States.
Our Rules Committee, led by Jordan Barnett,
drafted a letter to the Pennsylvania Sentencing
Commission answering prosecutors' attempts to
alter PA SSJI 413A.
Our Amicus Committee has been very
active. Co-chaired by Donna Walsh and Justin
Danilewitz, the committee will be submitting as
Amicus Curiae Brief in Commonwealth v. Cosby,
centered upon the over-application of Rule
404(b) by the Commonwealth in that and other
matters across the Commonwealth. The brief
has been drafted by member Brandon Ging of
the Allegheny County Public Defender's Office.
I had the privilege of recently participating in
an Amicus Committee conference call on this
matter and the brain power on that call was
awe-inspiring. We are truly privileged to have
such dedicated, talented members. I thank them
all.
Our Chichkin Task Force, comprised of
fourteen of our members, is finalizing the last
of its publications to the membership (which
will all be available on both the Listserv and
web site). The task force was comprised of three
separate groups: handling current and future
ARD's, answering prosecutors' attempted use of
prior ARD's at sentencing and PCRA/appellate
issues and the potential retroactivity of the
