Confronting the New Reality:
Protecting Your Client's Right to Confront
Witnesses During the COVID-19 Era

s courts in Pennsylvania and across the
country plan for the resumption of
in-person criminal trials, judges and
court administrators must balance the risk of
COVID-19 transmission with ensuring that judicial
proceedings protect the rights of the accused.
Jurisdictions are trying different approaches
to address these challenges, but most require
compliance with federal Centers for Disease
Control and Prevention (CDC)1 and state
directives2 regarding wearing masks for in-person
proceedings.3 To further reduce risks to public
health, many courts are encouraging the use
of advanced communication technology, such
as telephonic and video conferencing, so that
proceedings can be conducted fully or partially
remotely.4

While these public safety measures may work
well for civil hearings and trials, they pose
serious constitutional concerns for criminal
proceedings, such as jury trials, which implicate
the defendant's state and federal constitutional
rights to confront witnesses. Practitioners
should be familiar with the state and federal
Confrontation Clause rights and consider how
these safety arrangements may infringe upon
them. Notably, practitioners should prepare for
government requests or court plans to permit
witnesses to testify remotely or while wearing
masks.
