The Art of Communicating for

Life During COVID
	Noon
Kristen Nelson and Julianne Hill, The Phillips Project

While all capital defense attorneys have the obligation to seek
and convey plea offers, this webinar will focus on the art of
negotiating and successfully getting both the prosecutor and
your client to say " yes " to a non-death outcome. The speakers
will discuss the communication frameworks and strategies they
have found to be most effective in the successful resolution
of capital cases, as well as the unique opportunities and
challenges presented by the COVID-19 pandemic.

December 8, 2020
March to Now: Addressing

Day-to-Day Psychological

Challenges in the COVID-19

World

4:00 p.m.
Dr. Thomas Haworth and Dr. Elliot Atkins

The fatigue of this year's change is undeniable. As we near the
end of 2020, we reflect on how far we, as criminal defense
lawyers, have come from the first day of quarantine. The
difference between how we started our new normal in March
and progressed through intermittent court openings, remote
and hybrid school learning, and new ways of practicing law
proves just how adaptable we are. Although the trauma of
the onset of the pandemic may have subsided, new issues
continuously arise.
So now that we are 8 months into this, what is psychologically
going on? How are we doing, as both professionals and people?
Join PACDL's continued Mental Health Series presented by the
NexGen Committee.

December 10, 2020
The Ethics of Raising Race in

Capital Cases
	Noon
La Mer Kyle-Griffiths, And She Still Rises

again that the death penalty is a near-uniformly race-based
punishment in the United States. This webinar will discuss the
lawyer's ethical duty to raise race-based challenges, motions,
and arguments. It will also reference judicial responses to
claims of racial discrimination and how to handle them
ethically. Finally, this webinar will also focus of counseling and
developing relationships with the capital case client and his/
her family over time.

Integrating Race and Culture into

Death Penalty Cases
	Noon
Twyla Carter, The Bail Project

Twyla Carter will discuss the history of slavery and how white
supremacy and racism continue to permeate American society
so that you can weave race and culture into your criminal
and death penalty cases to help you tell your client's personal
story. It will also discuss the steps needed to educate a jury,
take inventory of what they do and don't know and how to
listen to the voices of others so you can include their values,
attitudes and beliefs when doing the necessary work of your
capital case.

Increasing The Odds in Your

Favor When Defending

the Gambling Addict
	Noon
Lia Nower, JD, Ph.D., Center for Gambling Studies,
Rutgers University, NJ

The rapid expansion of legalized gambling has all but ignored
a growing but hidden consequence: gambling disorder.
Most people gamble for recreation only, but a proportion
will develop an addiction to gambling so severe they will
experience bankruptcy, homelessness, job loss, and family
disruption. Similar to substance-based addictions, problem
gamblers suffer symptoms of tolerance and withdrawal
and often commit crimes to fuel continued play. However,
many people still view excessive gambling as a " vice " not an
addiction and may be reluctant to believe that a behavior
can evoke changes in the brain analogous to a substance.
Problem gamblers can conceal the extent their addictions
until the damage is irreparable and the consequences, severe.
Expert testimony can be critical to a criminal defense strategy
to explain this complicated and confusing behavior. This
webinar will discuss the hallmarks of gambling addiction,
the impact of the conduct on behavior, and ways an expert
can inform the Court or jury that this behavior is not the
result of irresponsible individuals. It will also focus on how to
determine the qualifications of a gambling expert, effectively
use expert testimony in sentencing presentations, and
successfully communicate the expert's detailed report.

Examining the SANE Exam
	Noon
Dr. Kathleen Brown, University of Pennsylvania
A Sexual Assault Nurse Examiner (SANE) is a certification
for registered nurses who have completed specialized

geared toward the collection, preparation, evaluation,
and production of evidence in a sexual assault case.
This webinar will include a review the scope of the
expertise of a SANE, the assessment of a sexual assault
patient, and evidence collection. It also will undertake
a detailed analysis of the SANE documentation, and
the information that should be included in the report.
Inconsistencies, taint and other errors and omissions
commonly occurring with a SANE forensic medical
examination will also be addressed.
