For the Defense - Vol. 8, Issue 3 - 12

Following the New York case, U.S. District Judge Brantley
Starr in the Northern District of Texas took steps to address
this specific issue. On May 30, 2023, Judge Starr issued an order
recognizing concerns regarding the legal research generated
by current AI systems, which he described as prone to
" hallucinations and bias. " In his order, Judge Starr emphasized
that lawyers, not AI, have taken an oath to uphold the law
and represent their clients. Consequently, Judge Starr's order
mandates that all attorneys appearing before the Court
must submit a certificate on the docket. This certificate must
either affirm that no part of their filing was composed using
generative artificial intelligence (such as ChatGPT, Harvey.AI,
or Google Bard), or confirm that any language generated
by generative artificial intelligence was verified for accuracy
by a human being using print reporters or traditional legal
databases.5
If you're curious about a real-life robotic lawyer, look no
further than DoNotPay, proudly billing itself as the world's
first robot lawyer.6
Founded by Joshua Browder, a student at
Stanford University, this AI-powered legal tool was created to
assist individuals with minor legal issues, such as unpaid parking
tickets. According to DoNotPay, as of 2023, the platform has
been used in 250,000 cases, boasting an impressive success rate
of 64 percent. Not surprisingly, in a classic case of " no good
deed goes unpunished, " the company recently faced a classaction
lawsuit. The complaint alleges that DoNotPay lacks
legal competence since it is not a robot, a lawyer, or a law firm,
lacks a law degree, lacks licensing in any jurisdiction, and lacks
supervision by any lawyer.7
It comes as no surprise that the legal players armed with
extensive legal databases are entering the arena, now that
ChatGPT has proved its worth. On May 5, 2023, LexisNexis
announced the launch of its new product, Lexis+ AI, which
harnesses the power of large language models (LLMs),
including GPT-4, to assist with legal research. Lexis+ AI can
answer questions, provide summaries of legal issues, and even
generate drafts of legal documents like demand letters or
client emails. The interface of Lexis+ AI is similar to that of
ChatGPT, with a prompt and response format.8
Currently, Lexis+ AI is available to select Am Law 50 firms,
such as Baker McKenzie, Reed Smith, and Foley & Lardner,
who are participating in a commercial preview. However,
it is expected to become widely available later this summer.
Following Lexis's announcement, Thomson Reuters, the
owner of Westlaw, another legal research giant, revealed its
plan to invest $100 million annually in artificial intelligence.
They intend to incorporate generative AI into their flagship
products starting in the second half of this year.9
However,
Lexis's decision to limit the rollout is a disappointing oversight,
as this technology is too crucial to be accessible only to a select
few in a specific area of law.
One of the standout advantages of Lexis+ AI is its ability to
address the " hallucination problem " by drawing from trusted
and authoritative content directly from LexisNexis's legal
database. Once Lexis+ AI becomes commercially available, it will
be offered as an independent product for purchase, separate
from other LexisNexis subscriptions. Concerns regarding
security, privacy, and client confidentiality have not gone
unnoticed. Lexis+ AI emphasizes its commitment to building
a private model interaction, ensuring that user interactions
remain isolated, and that no user information is shared with
other users. To ensure this, Lexis+ AI has formed partnerships
with major cloud providers like Microsoft and Amazon Web
Services, guaranteeing a completely private infrastructure.
As AI language models continue to advance and proliferate,
it is understandable that many lawyers harbor anxieties
about being replaced by robots amidst the rapidly changing
technological landscape. As an avid chess enthusiast, I
empathize with their concerns. In 1997, IBM's Deep Blue became
