Bird stresses that software alone may not solve the problem of illegal sharing; education is still the key. “We allow administrators to deliver educational content to students. The reason for that is in residence halls we’ve seen statistically that 90 percent of students will stop after the first offense. They just need to be directed in the right way. Students make the right choice when they understand the problem,” Bird explains. Heller agrees that technology-based deterrents alone may not be the best solution, and their expense may create an obstacle for many institutions. “The regulations don’t require technology as they stand right now, and there will be an enormous outcry about the cost if it comes to making the technology solution a requirement,” says Heller. “I find it hard to believe the technology could ever be a solution. You won’t be able to discern what’s legal and not legal. There really isn’t technology that’s truly foolproof at this point, particularly considering confidentiality.” EDUCAUSE does not support making technology a requirement and is working with the Department of Education to make sure that the regulations don’t turn campus officials into intellectual property police. “To the extent that additional regulations are written, it is important that they do not go beyond the specific requirements listed in the legislation,” says Worona. “There should be included a clear statement that each institution is intended to determine its own approach to ‘effectively combat’ infringement; that no particular technology-based measures are mandated; that there is no requirement to monitor, block, or filter network traffic; and that ‘technology-based deterrents’ fall into a wide range of categories.” Regardless of the results of these negotiations, Heller and his colleagues at UCLA are looking beyond the regulations in order to understand what this will mean to their students: “We just need to make sure that our policies are in alignment, but what’s more important is the behavior of our students.
